Regular Meeting <br /> <br />April 13, 1981 <br /> <br />Page 5 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, GRANTING TO RIVER TAXI <br />SERVICE A FRANCHISE FOR THREE YEARS TO OPERATE <br />AND ~INTAIN A TAXI SERVICE WITHIN THE CORPORATE <br />LIMITS OF SAID CITY FOR THE PURPOSE OF TRANSPORT- <br />ING PERSONS USING INNERTUBES ON THE SAN ~-~RCOS <br />RIVER; PRESCRIBING THE TERMS, CONDITIONS, OBLIGA- <br />TIONS AND LIMITATIONS UPON WHICH FRANCHISE SHALL <br />BE EXERCISED AND SETTING AN EFFECTIVE DATE. <br /> <br />Mr. Tarbutton moved to table the Ordinance granting the franchise <br />to River Taxi Service and Mrs. Norris seconded the motion, which <br />passed unanimously. City Attorney Barbara Jean Edwards stated <br />that the owner of River Taxi Service is thinking of selling his <br />business, and if the City grants a franchise to River Taxi Service, <br />that is who is going to be the holder of that franchise, and she <br />thinks it should be made clear they cannot sell the franchise with- <br />out the person purchasing it coming back to the Council for approval. <br />It was the City Attorney's recommendation that Mr. Duke come before <br />the Council and tell the Council he intends to operate the business <br />or give his plans. Mr. Stokes instructed that this matter be placed <br />on the Agenda of the next meeting, April 27, 1981, or at whatever time <br />Mr. Duke can be present for Council Meeting. <br /> <br />Mr. Stokes introduced for consideration an Ordinance on first reading, <br />read in its entirety, changing the zoning of 45.70 acres out of the <br />J. M. Veramendi League No. Two, located on I.H. 35 North, from "D" <br />(Multi-Family), "M" (Mixed) and "C" (Commercial) to "C" (Commercial) <br />and "LI" (Light Industrial). <br /> <br />Mrs. Norris moved to approve on first reading and Mr. James seconded <br />the motion, which passed unanimously. <br /> <br />Mr. Stokes introduced for consideration an Ordinance on first reading <br />and a public hearing, changing the zoning of 0.467 acres out of the J. <br />M. Veramendi League No. One, located on Hunter Road, from "AO" (Agri- <br />cultural-Open Space District) to "C" (Commercial). The Mayor Pro-Tem <br />then opened the public hearing. No one wished to speak for or against <br />the zoning request. The Mayor Pro-Tem then closed the public hearing. <br />The City Secretary then read the Ordinance in its entirety, the caption <br />of which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS ~ENDING SECTION 3 OF THAT <br />ORDINANCE WHICH REGULATES AND RESTRICTS THE LOCA- <br />TION AND USE OF BUILDINGS, STRUCTURES AND LAND, <br />DATED SEPTEMBER 29, 1980 (VOL. 54) BY ZONING 0.467 <br />ACRES OUT OF THE J. M. VERAMENDI LEAGUE NO. ONE, <br />LOCATED ON HUNTER ROAD, FR~ "AO" (AGRICULTURAL- <br />OPEN SPACE DISTRICT) TO ~'iC" (COMMERCIAL). <br /> <br />Mr. Cavazos moved to approve the Ordinance on first reading and Mrs. <br />Norris seconded the motion, which passed unanimously. <br /> <br />Mr. Stokes introduced for consideration an Ordinance on first reading <br />and a public hearing changing the zoning of Lots 2 and 3 in Block 4 <br />of the McNaughton Addition, located at 1012 Academy, from "R-i" (Single <br />Family Residential) to "D" (Multi-Family Dwelling District). The Mayor <br />Pro-Tem then opened the public hearing, but advised that this zoning <br />change was withdrawn when it was presented to P and Z, but wanted the <br />pros and cons presented to the Council for if and when it comes back <br />before the Council again. No one wished to speak in favor of the zon- <br />ing request and Messrs. Bob Thomas and Gilbert Fulmer opposed the zon- <br />ing request. The Mayor Pro-Tem then closed the public hearing. <br /> <br />Mr. Stokes moved to table the Ordinance until the Council gets a re- <br />commendation from P and Z and Mr. James seconded the motion, which. <br />passed unanimously. <br /> <br /> <br />
