<br />II <br /> <br />I <br /> <br />I <br /> <br />/3 (? tt"! <br /> <br />AND WHEREAS, the City Council has duly ascertained and <br />determined that said claims were incurred in constructing fire <br />stations, including architect's fee in connection therewith, and <br />purchasing fire equipment for said City as contemplated and <br />authorized by the aforesaid ordinance of September 7, 1955; and, <br />WHEREAS, the City Council finds and determines that the work <br />performed by Horace C. Howard under his contract with the City of <br />San Marcos dated January 31, 1956, has been inspected and found <br />acceptable under said contract; that said contractor has complied <br />with all the terms and conditions of said contract; that the work <br />provided for in the contract has been fully and satisfactorily <br />completed, and that the entire amount due said contractor and due <br />Frank T. Drought, for architectural and engineering services, is <br />now due and payable; and <br />WHEREAS, said claims have been duly audited and have been <br />found and determined to be valid and unpaid claims against said <br />City of San Marcos; and, <br />WHEREAS, said claims in the total amount of $12,875.06 have <br />been duly and legally transferred and assigned to the FIRST NATIONAL <br />BANK, SAN MARCOS, TEXAS; and, <br />WHEREAS, it was provided in said ordinance above referred to <br />that said warrants above described should be executed, issued and <br />delivered in payment of claims duly approved, audited and allowed <br />by the City Council; and, <br />WHEREAS, the City Council desires to approve and allow said <br />claims and to authorize the delivery of CITY OF SAN MARCOS FIRE <br />STATION AND EQUIPMENT WARRANTS to evidence said indebtedness; <br />THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS: <br /> <br />L <br />That the claims hereinabove listed incurred in the purchase <br />of fire equipment for the City of San Marcos and in constructing <br />fire stations for said City, including architect's fee in <br />
