<br />I <br /> <br />I <br /> <br />I <br /> <br />_I, <br />/1-- <br /> <br />~!~Q~Q!!Q~ <br /> <br />WHEREAS, the Board of Aldermen of the City of San <br />Marcos has found that public necessity requires the widening <br />of Texas-U. S. Highway No. 81 through the City of San Marcos, <br />in Hays County, Texas; and, <br />WHEREAS, the Board of Aldermen has found and ,determined <br />that the hereinafter described land is suitable for such purpose <br />and that it is necessary to acquire said land for such street, <br />highway, and freeway purposes; and, <br />WHEREAS, the City of San Marcos has negotiated with <br />Service Investment Corporation, a Texas corporation, as the <br />owner of such land, and has been unable to agree with such <br />owner as to the fair cash market value thereof, Now, Therefore, <br />3E IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY <br />OF SAN D~RCOS: <br />That Ernest Morgan and Tom G. Oliver, Jr., be, and <br />they are hereby employed as attorneys at law to represent the <br />City of San Marcos in said behalf, and that they be and are <br />hereby authorized, empowered, and directed to file against <br />all owners and lienholders, a suit in eminent domain to acquire <br />the fee simple title for said purposes to the following described <br />tract of land; <br />Field notes of a survey of 0,140 acre of land, being <br />the southeast portion of Lots Twenty-Two (22), Twenty-Three (23) <br />and Twenty-Four (24) of the John T. Cox Subdivision, a subdivision <br />of record in Volume 153, page 260, Hays County Deed Records, <br />said John T. Cox Subdivision being a resubdivision of the <br />Southeast one-half (1/2) of Lot No. Fifteen (15) of the A. F. <br />Weatherford Subdivision as conveyed in a deed from A. F. Weather- <br />ford and wife, Mrs. Dorothy Weatherford, to Mrs. Virginia D, <br />Cox, and recorded in Volume 134, page 106, Hays County Deed <br />Records, said land herein described was conveyed in a deed from <br />
