<br />I <br /> <br />I <br /> <br />I <br /> <br />. . - ")0 <br /> <br />ORDINANCE <br />AN ORDINANCE DECLARING ABANDONED, DISCONTINUED AND CLOSED <br />AS A PUBLIC STREET, CERTAIN PORTIONS OF LOOP STREET IN THE_ <br />BLANKENSHIP & CARRUTHE:RS ADDITION TO THE CITY OF SAN MARCOS, HAYS <br />COUNTY, TEXAS; AND AUTHORIZING AND EMPOWERING THE MAYOR OF THE CITY <br />OF SAN MARCOS TO EXECUTE AND DELIVER QUITCLAIM DEEDS TO J. SEARCY <br />SHITH AND ROSS ARNOLD OF THOSE CERTAIN PORTIONS OF LOOP STREET WHICH <br />ARE HEREBY DECLARED TO BE ABANDONED, DISCONTINUED AND CLOSED. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AS FOLLOWS: <br /> <br />Section 1. That the portions of Loop Street in the City of <br />San Marcos, Hays County, Texas, hereinafter described by metes and <br />bounds, such portions of said street being located within the <br />Blankenship and Carruthers Addition to the City of San Marcos, as per <br />and deed of dedication <br />map or plat/of said addition of record in Volume 56, page 460, Hays <br />County Deed Records, to which map or plat, and the record thereof, <br />reference is here made and same made a part hereof for descriptive <br />and all other pertinent purposes, are hereby decreed to be abandoned, <br />discontinued and closed as a public street for the following reasons: <br />(a) The above-mentioned deed of dedication has Dever been <br />accepted by the City of San Marcos, <br />(b) The City of San Marcos has never exercised, nor is it <br />now exercising, any jurisdiction over the hereinafter described por- <br />tions of Loop Street. <br />(c) The hereinafter described portions of Loop Street have <br />never been worked, graded or maintained in any fashion by the City <br />of San Marcos. <br /> <br />(d) The general public very seldom has made use of the <br />hereinafter described portions of Loop Street during the forty-eight <br />years since same were dedicated to the public, it is making no use <br />whatsoever thereof at this time, and it is very unlikely to make use <br />thereof at any time in the future. <br />(e) That continued responsibility in the City of San Marcos <br />for the use by the public of the hereinafter described portions of <br />Loop Street is unnecessary, relief from which responsibility will be <br />
