Lowman. Therefore, the leased <br />premises are so leased subject to said easements. <br />The above-mentioned deed from Robert P. LOWlll&n to the City of <br />San Marcos states that the conveyance is subject to the grantee's <br />using the premises as a municipal airport continuously for twenty years <br />from the 4th day of December, 1954. In the event of conflict between <br />that provision and tbe terme of tbis lease. the former shall control <br />in all respects1 and. furthermore. Lessee agrees that he will do <br />nothing to prevent the continued use of the leased premises by Lessor <br />as a municipal airport. <br />The above-mentioned deed of dedication of the Municipal <br />Airport Subdivision contains three restriction. as follows; <br />"a. No structure or appurtenances of any kind shall be <br />placed on any part of said subdivision on or within 150 feet of said <br />runways for twenty years that will interfere with the proper and 1'IW" <br />ful use and operation of the said runways and said 4.83 acres as a <br />lWnicipa1 airport. Nor shall any structure higher than 15 feet be <br />constructed on any other part of said land in seid subdivision without <br />first obtaining a permit from the Municipal Airport Board or govern- <br />ing body of the City of San &rcos. The Municipal Airport Board or <br />governing body of the City of San Marcos shall determine if any struc- <br />ture or appurtenance interferes with such airport operations. This <br />paragraph shall not be interpreted so as to restrict in any way the <br />planting of annual growing crops on any part of said subdivision out of <br />.aid nmways. <br />"b. An easement is reserved by the undersigned. his heirs <br />and assigns>> over a strip of land 10 feet wide and 150 fe,et Northwest <br />of the Southeast lines of Lots 1-27. and over a strip of land 10 feet <br />wide along the Northwest end of said lots and as designated on said <br />plat. for utility installation and maintenance. and no structure of a <br />permanent character which would interfere with said eaS81lIents sball be <br />erected on said ten foot strip, <br />
