<br />I <br /> <br />I <br /> <br />I <br /> <br />7. <br /> <br />~ <br />,)~:s 7 <br /> <br />The Engineers agree to make such revisions in the plans and <br />specifications as are necessary and as are satisfactory to the City, to <br />bring the project within the estimated construction cost hereinbefore set <br />out, such revisions to be made at the expense of the Engineers and without <br />cost to the City, whether or not said plans and/or specifications have here- <br />tofore been approved by the City; provided, shOUld the city desire any <br />material changes in the type of construction or other changes not necessary <br />to be made in order to bring the cost of the project within the said estimate, <br />then City shall pay the Engineers, for making such revisions, a fee to be <br />fixed by the parties at the time the change is ordered. <br />8. <br /> <br />The Engineers shall furnish to the City, for its own use, five <br />(5) sets, complete, of the plans and specifications at the Engineers' <br />expense. Additional sets will be furnished, as required, without cost to <br />the City, other than the direct expense of providing copies, blue prints of <br />drawings and other documents relating to the work. <br />g. <br />The City may terminate this contract in whole or in part, at any <br />time, after the completion of the Preliminary Phase, for the City's conven- <br />ience, or for the Engineers' default, or for any just cause, by written <br />notice to the Engineers. Upon such termination, all plans, specifications, <br />drawings, estimates, reports and other incidental related engineering work <br />and materials, completed or work in progress, for which the Engineers have <br />been paid by the City, shall become and remain the property of the City. If <br />termination is for the convenience of the City, the Engineers not being in <br />default, the compensation in the amount of that portion of the prescribed fee <br />which the work actually performed under this contract bears to the total <br />work called for, shall be paid the Engineers; in no event, will the Engi- <br />neers be allowed compensation for anticipated profits on unperformed work. <br />Upon receipt of notice of termination, the Engineers shall, unless directed <br />otherwise, immediately discontinue all services and work, the placing of <br />orders for services, assistance, facilities, and materials in connection <br />with the performance of this contract, and shall promptly cancel all existing <br />orders and contracts pertaining to this contract. If this contract is <br />terminated due to no fault of the Engineers and any compensation is due and <br />payable to the Engineers as hereinabove provided, there shall be deducted <br />from any such compensation so due and payable the payments previously made <br />
