November 7, 1944~ by the addition of Section 51-f, ATticl.e I!I, \fjhich <br />authorized the Legislature to establish a state~v,fide retirement and <br />disabili ty pension system fOT city employees; <br /> <br />'NHEHEAS, Chapter 75, Acts 50th Leg~,-slature (1947) as amended, <br />established The Iexas iVunici:)al Heti:rcment Systemt 2nd autno!'izes the' <br />governing body of each city 01' town to elect, at its option, to have one <br />01' morQ or the city departments pa.rticipate in such systfJm; and <br /> <br />dH2~.lEA3, the governing body of the City of 02n i/!arcos, Texas, <br />finds that it will be in the public i.nterest for the city to have its <br />employees participate in The Texas Municioal Retirement System as herein- <br />after provided; Now, therefore, <br /> <br />BE IT OHDAINED BY THE GOVEHNING BODY OF THE CITY OF SAN MAHCOS, <br /> <br />TE~AS ; <br /> <br />Section 1. That, 011 heh21f of the City of San l'~'laI'Cos~ Iexas~ <br />the City Council elects to have all of the employees of said city, except <br />the folloviing ~ <br /> <br />I <br /> <br />a~ Elected officials. <br />b. Tempo:r>ary employees. <br />c. Part-time employees (less tJ1an 1,000 hours <br />per year) ~ <br /> <br />(iligible to participate in 'The Texas ~/ur.icipal Retirement System as )yo- <br />vided in Chaptel' TJ, i\.cts of the 50th Legislature, as amendc~d, (Article <br />6243h of Vernon's Civil statutes of Texas); and all of the benefi,.ts and <br />obligations of such system are 11ereby accepted as to such eligible em- <br />ployees. <br /> <br />Section 2. Jne City Manager is hereby directed to notify the <br />Board of Trustees of The Texas tLunicipal Hetirem0nt :.3ystem that the City <br />of San Ivia:cco5, Texas, has elected to participate and have the eligible <br />employees of all departments participate in said System. <br /> <br />Section 3. Each person who becomes an eligible employee of <br />any participating department on or after the effective date of participa- <br />tion of such department shall become a member of The Texas ~.,'Iunic:ipal <br />Hetirement 3ystem as a condition of his employment. The City of San ;\f;arcos, <br />Texas, ma.y in t.he future refuse to add new departrfJents or ne'N employees to <br />such system, but shall neveI' discontinue as to any participants. <br /> <br />I <br /> <br />Section 4. In accordance vd th the provisions of the :.3tatute, <br />the deposits to be made to The Texas NIunicipal i"'etire:l1ent System on <br />account of current serv:tGe of the employees of Lie sevE..~ral paTticipa-ting <br />departments aTe hl~reby fixed at the rate of five per cent (5%) of the <br />eaTnings of each employee of said departments, and in detormining the <br />depo:3i.ts to be made on account of such service --the earnings of 2r.y <br />employee of &ny such de:J~rtllient in E)XcesS of the sum of Four Thousand <br />T\'~o Hundred Dollars (~4.,200.) in ahj7 one year shall not be considered. <br /> <br />3ection 5. The City Secretary is hereby directed to remit to <br />the Soard of Trustees of The Texas Municipal Retirement Systemt at its <br />office in Austin, Texas, the city.s contributions to the System and the <br />
