Texas, hereinafter sometimes referredtoas City, and <br />Echols, Inc., a Corporation, he~einafte~ sometimes called <br />Second Party, as f'ol1owtJ: <br />1. City hereby gi'Vesand grants unto Second Party <br />the right to operate a miniatUl'e golf course bUsiness at the <br />City's municipal park on the~st side of the San Marcos River <br />in the City of San Marcos in Hays County, TexBS.. The 10oation <br />of said golf oourse ,shall remain the same as it now is through- <br />out the term of th,is agreement. SeconaPal'ty shaUbe entitled <br />to make charges to the general public for the use of said golf <br />course. <br /> <br />2. This agreement sha 11 be intu11 torce and effect <br />from the date hereof and shall oontinue until, and terminate <br />upon, October 1, 1958, unless sooner terminated under soma <br />provision hereof. <br />3. Second Party agrees to keep the premises' on <br />whioi1 it operates it's business in a neat, clean,orderly manner, <br />keeping the grass and weeds out and mowed and keeping the premises <br />in a Sightly condition. <br />4. Asconeideration for this agreement, Second Party <br />agrees to pay to City a sum of money monthly equal to ten per <br />cent (10%) of the gross reoeipts realized by Second Party trom <br />the operation of it's business on said premises. Said sum of <br />money shall be paid to City on the first dayofeaoh month, <br />beginning on June 1, 1958,andcont1nuing througi1out the life <br />of this agreement.
