<br />249 <br /> <br />REGULAR ADJOURNED MEETIOO HElD ON FEBRUARY 17, 1959 <br /> <br />On the 17th day of February, 1959, at 9100 A.M., the Governing <br />Body of the City of San Marcos met in adjourned regular session, Mayor C. Fuller <br />Deputy City Secretary Joann Hayes <br />City Attorney"Ernest Morgan <br />Absent werel H. W. "Steakley <br /> <br />The meeting was called to order by Mayor Allen. City Attorney <br />Morgan explained the implications of the Constitutional Amendment passed <br />in November of 1958 (codified as Article XI, Section II of the Constitution) <br />concerning the leggth of the tern of office of city officials. It was not~d <br />that the length of term of city officials could be changed from 2 years to 4 <br />years if passed by a majority of the eligible voters of the city concerned. <br />This would not affect the term of the city officials in office at the time <br />this was passed by the voters, but would apply to the officials elected at that <br />and all subsequent elections. No provision had been included in the state <br />amendment whereby the cities might arrange to maintain "staggered" terms of <br />office for city officials under the four year terms. Alderman Hillburn intro- <br />duced an ordinance entitled AN ORDINANCE CALLING FOR AN ELECTION FOR THE PURPOSE <br />OF VOTIti3 ON THE QUE~TION OF WHETHER THE TERM OF THE OFFICE~ OF THE CITY OF <br />::IAN MARCOS TEXAS SHALL BE EXTENDED fROM TWO YEARS TO FOUR YEARs AS AUTHORIZED <br />BY SECTION II OF ARTICLE II OF THE CONSTITUTION OF TEXAS, and moved its adoption. <br />This motion was seconded by Alderman Korff. The ordinance was read in full <br />and upon roll call the ayes and nayes were as followSl <br /> <br />I <br /> <br />Ayesl Beecroft <br />Davis <br />Hillburn <br />Korff <br />Nayesl None <br />Whereupon the Mayor declared the ordinance passed, approved, and adopted. <br /> <br />For the benefit of the Council the City Attorney quoted from Article <br />2.02 of the Texas election codd which reads as follows I <br /> <br />I <br /> <br />"Art. 2.02. In cities and towns. <br />All provisions of this Code which prescribe qualifications for <br />voting and which regulate the holding of elections shall apply to <br />elections in cities and towns. The deadline for filing to get one's <br />name on the ballot in elections in cities and towns shall be thirty <br />(30) days before the date of the e~ection. In towns of cities <br />incorporated under the general laws, the governing body may provide <br />for city or town elections that 'there shall be one or more polling <br />places; and, in such case, the certified list of poll taxpaying <br />voters for all election precincts in which voters reside who are to <br />vote at any such polling place shall be used therefor. In all cities <br />and towns in which the number of electors at the last municipal <br />election does not exceed four hundred (400) in humber, but one election <br />poll shall be opened at any municipal election; and all officers of <br />such towns and cities to be elected sball be voted for at such poilil." <br /> <br />After some discussion a motion was made by Alderman Davis, seconded by Alderman <br />Beecroft, that the city have only one polling place at the election to be held <br />on April 7, 19594 and designated that polling place to be in the City Hall. <br />The motion was carried by a unanimous vote of the Council. <br /> <br />It was the common consent of the Council to leave open the problem of <br />staggering the terms of the City Officials until the 1960 election, on the <br />assumption that other cities faced with the same problem will have tested the <br />legality of the various solutions by that time. <br /> <br />"C <br />::: <br />I ~ <br />C/J <br />Q <br /> <br />091 <br />
