28 <br /> <br />Regular Meeting <br /> <br />April 27, 1981 <br /> <br />Page 4 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS AMENDING SECTIONS 2-27, 2-28 AND 2-29 <br />OF THE CODE OF ORDINANCES, CITY OF SAN MARCOS, TEXAS <br />TO ELIMINATE THE POWER OF THE PERSONNEL APPEALS BOARD <br />TO RENDER A FINAL DECISION IN PERSONNEL ACTIONS; TO <br />ESTABLISH THE CITY MANAGER AS THE FINAL AUTHORITY IN <br />PERSONNEL ~LATTERS; TO ESTABLISH THE CITY COUNCIL AS <br />THE APPOINTING AUTHORITY FOR THE PERSONNEL APPEALS <br />BOARD; TO ELIMINATE THE PROHIBITION AGAINST MEMBERS <br />OF THE PERSONNEL APPEALS BOARD SERVING ON OTHER CITY <br />BOARDS, COMMISSIONS AND CO~ITTEES AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />Mr. James moved that the Ordinance be approved on second reading <br />and Mr. Cavazos seconded the motion, which passed unanimously. <br /> <br />Mr. Stokes introduced for consideration authorizing payment in <br />settlement of a claim against the City by Josie Dominguez. City <br />Attorney Barbara Jean Edwards recommended the~!Council authorize <br />payment in the amount of $250.00 from the contingency fund in set- <br />tlement of the claim, payment to be made upon receipt of a properly <br />executed release by Ms. Dominguez. Ms. Edwards noted that although <br />the damages were speculative and there was the possibility of a <br />statute of limitations defense, litigation would cost the City more <br />than $250.00. Mrs. Norris moved that payment be made and Mr. James <br />seconded the motion. On roll call the following vote was recorded: <br /> <br />AYE: Brown, James, Stokes, Norris and Tarbutton. <br /> <br />NAY: Cavazos. <br /> <br />ABSTAIN: None. <br /> <br />Mr. Stokes introduced for consideration the report of Greater San <br />Marcos Council of Neighborhood Association. Mr. Joe Cox, Jr., Co- <br />Chairman of the Association, read the letter addressed to City <br />Manager A. C. Gonzalez dated April 14, 1981, which letter is at- <br />tached to these minutes. <br /> <br />Mr. Stokes introduced for consideration a proposed date for a Joint <br />Workshop with Planning and Zoning to consider Charter Amendment for <br />the creation of separate Planning and Zoning Committees. Mr. James <br />moved that the Joint Workshop be placed on the Planning and Zoning <br />agenda for their next scheduled meeting, which will be May 19 (the <br />third Tuesday in May) and Mr. Tarbutton seconded the motion, which <br />passed unanimously. The Council directed that all members of the <br />Master Plan and Planning and Zoning Commission be notified of this <br />meeting. <br /> <br />The meeting adjourned at 9:05 p.m. on motion of Mr. Cavazos and se- <br /> <br />conded by Mrs. Norris. <br /> <br /> 1 W.
