<br />I <br /> <br />I <br /> <br />I <br /> <br />61 <br /> <br />PERSON I Every natural person, firm, corporation, association, or <br />co-partnership. <br />CURB LINE: The Boundary of that portion of any street which is <br />improved, designed or ordinarily used for vehicular traffic. <br />SECTION 2. (a) It shall be unlawful for any person to place or cause <br />to be placed any plant having a height greater than three (3) feet above <br />the level of the center of the nearest abutting street, on or in that portion <br />of any corner lot in the City of San Marcos, which portion is included in a <br />triangle on the street corner of the lot formed by a diagonal line intersect- <br />ing the property lines at points twenty (20) feet from the street corner <br />intersection of the property lines. <br />(b) It shall be unlawful for any person to construct or replace, or <br />cause to be constructed or replace, on the portion of a corner lot described <br />in the paragraph next preceding any fence of such a kind or height as to <br />prevent traffic approaching the intersection on any street from clearly <br />seeing traffic approaching the intersection on another street. <br />(c) The owner or occupant of such corner lot, or any nurseryman, nur- <br />sery employee, or other persons who shall violate any of the provisions of <br />subsections (a) or (b) of this Ordinance shall be deemed guilty of a misde- <br />meanor, and upon conviction thereof shall be fined in any sum not less than <br />Five ($5.00) Dollars nor more than Fifty ($50.00) Dollars. <br />SECTION 3. (a) It shall be unlawful for either the owner or the <br />occupant of any corner lot in the City of San Marcos to place, maintain or <br />permit or cause to be placed or maintained any.plant having a height <br />greater than three (3) feet above the level of the center of the nearest <br />abutting street on or in that area which lines between the property line or <br />lines of such corner lot and the curb lines of streets abutting such property <br />lines and which area extends for a distance of fifty (50) feet Back from <br />the intersection of the curb lines of such abutting streets. <br />(b) It shall be unlawful for either the owner or the occupant of any <br />property in the City of San Marcos to place, maintain or permit or cause to <br />be placed or maintained thereon any tree or plant within five (5) feet of <br />any fire hydrant in the City of San Marcos. <br />(c) It shall be unlawful for the owner or occupant of any property <br />in the City of San Marcos to maintain or permit limbs of trees growing thereon <br />
