<br />I <br /> <br />I <br /> <br />63 <br /> <br />to overhang or grow above the area between his property line and the curb <br /> <br /> <br />line of any abutting street unless such limbs and all branches and foliage <br /> <br /> <br />thereon are kept trimmed and pruned to a minimum of eight (8) feet above <br /> <br /> <br />the street level at the nearest curb line. <br /> <br />(c) It shall be the duty of the Chief of Police to cause a written <br />notice to be served upon the owner or occupant of any property upon which <br />any violation of Section 3 of this Ordinance exists to correct such condition <br />as constitutes a violation of any of said Section within ten (10) days after <br />serving such notice; and if such condition is not corrected or remedied or <br /> <br /> <br />caused to be corrected or remedied by such person by the end of ten (10) <br /> <br /> <br />days' notice, the City Manager is hereby authorized and directed to cause <br /> <br /> <br />the tree or plant or part thereof constituting such violation to be so <br /> <br /> <br />trimmed, pruned or removed as to eliminate the prohibited condition. <br /> <br /> <br />(e) The owner or occupant or any property who shall fail to trim, <br /> <br /> <br />prune or remove any such tree or plant or part thereof.as required by Section <br /> <br /> <br />3 of this Ordinance within ten (10) days after service of such written notice <br /> <br /> <br />by the Chief of POlice, shall be .deemed guilty of amisdemunor and upon <br /> <br /> <br />conviction thereof shall be fined in any sum not less than Five ($5.00) <br /> <br /> <br />nor more than Fifty ($50.00) Dollars. A separate offense shall be deemed <br /> <br /> <br />to have been committed on every day that any such tree or plant is permitted <br /> <br /> <br />to remain after the expiration of said period of ten (10) days after the <br /> <br /> <br />service of said notice. <br /> <br />(f) Any nurseryman, nursery employee, or other person other than the <br /> <br /> <br />owner or occupant of property affected by Section 3 of the Ordinance, who <br /> <br /> <br />places or causes to be placed any tree or plant affected by said Section, <br /> <br /> <br />shall be guilty of a misdemeanor and upon conviction thereof shall be fined <br /> <br /> <br />in any sum not less than Five ($5.00) Dollars nor more than Fifty ($50.00) <br /> <br /> <br />Dollars. <br /> <br />SECTION 4. (a) The City Manager is hereby authorized to remove, or <br />III cause to be removed, any trees or plants found between the opposite curb <br />lines in any street in the City of San Marcos, and to trim branches, limbs <br />or foliage of any tree or plant which overhangs or grows above the area <br />which lies between the opposite curb lines of any street, so as to provide a <br />minimum clearance of eight (8) feet above the street level at the curb line <br />and so as to be graduated toward the center of the street to a clearance of <br />
