J II I compensation based on the following amounts and rates for such profess- ional engineering services. A. Upon completion of the Preliminary Phase the Engineer shall be reimbursed with the cost of the work actually done, but in no event to exceed a sum equal to $600. B. The Design Phase. The Engineer shall be entitled to compensation for the work actually done, but in no event to exceed the amount of $2000.00, i.cluding the $600.00 for the Preliminary Phase as above. C. COnstruction Phase. At the completion Qf the eonstruction Phase the Engineer shall be entitled to $750.00, ~kin9 a total maximum engineer- ing cost for the completed facility of $2750.00. V. After the completion of the Preliminary Phase of this contract, the City, at option, may terminate this contract at any time; and in the event of such termination, the Engineer not being in default, the Engineer shall be paid a sum of money which bears the same proportion to the total fee provided for in this contract as the work actually performed .at the time of termination bears to the total work to be performed hereunder. Upon the termination of the contract, all plans, specifications, drawings, estimates, reports, and other related working materials, comple- ted, or work in progress, for which the Engineer has been paid by the City, shall become and remain the property of the City. The City agrees to pay for all work performed under this contract within thirty days of the date of presentation to City of a proper invoice from the Engineer, all payments hereunder to be made at the City Hall in San Marcos, Hays County, Texas, the place here fixed forperfoxmance of this contract. VI. The Engineer Shall deliver to the City for the City's use five com- plete sets of prints, drawings, or the copies of all drawings, specifi- cations, and contract documents, in addition, the Engineer shall furnish
