The minutes of <br />the meeting of August 11, 1959 were approved as read. <br /> <br />The regular order of business was dispensed with to hear Mr. <br />Thomas Leffingwell who appeared before the Council on behalf of <br />property owners that will be effected by right-of-way requirements <br />for improvements to Ranch Road 12. He requested that the Council <br />use its influence with the State Highway Department to reroute the <br />proposed improvements from Moore St. to Bishop St. Mr. Leffingwell <br />brought out three main objections to the Moore St. route. <br />1. A Junior High School is located next to Moore St. <br />2. The number of property owners involved on Moore St. is <br />nearly twice as many as would be involved on Bishop St. <br />3. The Bishop St. route would cost the City less than the <br />Moore St. route. <br /> <br />Mayor Allen reminded the property owners that the choice of route <br />was not made by the Council, but by the State. He suggested that Mr. <br />Tom Wood, Resident Highway Engineer be requested to come to San Marcos <br />to talk with each of the property owners effected. A one week notice <br />would be given. The suggestion seemed agreeable with all. <br /> <br />I <br /> <br />Mr. J. C. Hartley appeared before the Council to request the City <br />transfer its title to the walkways between his cemetery lots to him so <br />that he may begin construction on his proposed mausoleum. On advice <br />from the City Attorney the Council informed Mr. Hartley that it has no <br />legal power to do such. Mr. Hartley then suggested that a new site be <br />chosen in a part of the cemetery that has not been platted. He suggested <br />that he trade the lots he now owns for a piece of property equal in size. <br />The City Manager suggested that the City Attorney be consulted about any <br />restrictions the unplatted property might have. The Council then unanimously <br />decided that Mr. Hartley should first see the City Attorney and then go <br />to the Cemetery Association and clear with them. If there are no restrictions <br />or objections to the new site Mr. Hartley should then have his proposed site <br />surveyed and marked at his own expense. At that time the matter would be <br />again considered by the Council. <br /> <br />A letter from the City Attorney, addressed to the Mayor, setting <br />forth the requirements regulating perpetual care of cemeteries by the <br />City was noted by the Council. <br />
