The County reserves the right to designate, and has <br /> <br />so designated by an order of the Commissioner's Court, the <br /> <br />specific geographic area in Precinct One of Hays County <br /> <br />wherein the City shall be responsible for fire service and the <br /> <br />citizens of Hays County have been notified of the City's <br /> <br />responsible area. <br /> <br />B. The parties further agree that this contract may <br /> <br />be renewed as written or with modifications thereto by order <br /> <br />of the Commissioner's Court of Hays County, Texas, taken <br /> <br />within thirty days prior to the expiration date hereof, and <br /> <br />upon acceptance by the City. <br /> <br />C. The County of Hays agrees to indemnify and hold harm- <br /> <br />less the City of San Marcos for any damages or injuries to <br /> <br />equipment, employees, agents, workmen, or volunteer firemen <br /> <br />of the City of San Marcos, or to any person or person's <br /> <br />property as a result of answering or performing fire calls <br /> <br />outside the city limits of the City of San Marcos. Should <br /> <br />any person asserting claim, causes of action, or file suit <br /> <br />for damages to his person or his property, then the County <br /> <br />of Hays agrees to defend all claims, causes of action, or <br /> <br />suits; provided, however, that by this agreement the County <br /> <br />does not waive, but does specifically reserve, every common <br /> <br />law defense which it might otherwise plead with respect to <br /> <br />any person injured in his person or property or both as <br /> <br />herein set out. <br /> <br />D. It is understood and agreed that should the City of <br /> <br />San Marcos Fire Insurance Key Rate be jeopardized in any <br /> <br />manner as a result of answering fire calls outside the city <br /> <br />limits, then the City of San Marcos shall have the right to <br /> <br />/ ?~>' <br />, ./ j~. <br /> <br />';1F1; <br />').'\ <br />
