Regular Meeting May 11, 1981 42 Page 3 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING CHAPTER 12, ENTITLED "GARBAGE AND TRASH", OF THE CODE OF ORDINANCES OF SAID CITY TO INCLUDE A NEW SECTION REQUIRING A DEPOSIT TO OBTAIN GARBAGE SERVICE FROM SAID CITY WHEN CITY UTILITY SER- VICE IS NOT PROVIDED TO THE SAME SITE AND SETTING THE AMOUNT OF SAID DEPOSIT FOR DIFFERENT TYPES OF SERVICE AND DECLARING AN EMERGENCY. This Ordinance was considered on emergency basis. Mrs. Norris moved to adopt the Ordinance and Mr. Kreczmer seconded the motion, which passed unanimously. Mr. James introduced for consideration an Ordinance to amend Ordinance 1980-37, which sets forth expense of conducting each department of the City for the fiscal year beginning October 1, 1980. Also considered in conjunction with this Ordinance was the acceptance of bids of a sideloader and cannisters. The Ordinance was read in its entirety, having the following caption: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING ORDINANCE 1980-37, ADOPTED SEPTEMBER 8, 1980, WHICH SET FORTH AN ITEMIZED ESTI- MATE OF THE EXPENSE OF CONDUCTING EACH DEPARTMENT, DIVISION AND OFFICE OF THE MUNICIPAL GOVERNMENT OF SAID CITY FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 1980 AND ENDING ON SEPTEMBER 30, 1981 AND APPRO- PRIATED MONEY FOR THE VARIOUS FUNDS AND PURPOSES OF SUCH ESTIMATE TO REVISE SAID ESTIMATES AND TO REAP- PROPRIATE SAID FUNDS ADOPTING SAID REVISIONS AND ESTIMATES AND DECLARING AN EMERGENCY. This Ordinance was considered on an emergency basis. Mrs. Norris moved to adopt the Ordinance and Mrs. Mendez seconded the motion, which passed unanimously. It was necessary to amend Ordinance 1980-37 in order to consider the purchase of the sideloader and cannisters. Mr. James then introduced for consideration the acceptance of bids of a sideloader and cannisters. Mr. James moved to accept the bid to purchase a diesel sideloader and cannisters and Mr. Cavazos se- conded the motion, which passed unanimously. Mr. James introduced for consideration a public hearing to consider amending the General Zoning Ordinance to require conditional use per- mit rather than specific use permit for bars, nightclubs and taverns located in light industrial districts and bars and nightclubs located in commercial districts in the City. No one spoke in favor of the amendment and two men opposed any more bars of any kind being allowed to open in San Marcos. After much discussion the matter was tabled until the Staff could make a report stating the current conditions that are stipulated and with the direction of Mr. Craig Farmer what areas might be stiffened to avoid further problems. Mrs. Norris moved that the Ordinance be tabled and Mrs. Mendez seconded the mo- tion, which passed unanimously. Mr. James introduced for consideration an ©rdinance on first reading, which was read in its entirety, having the following caption: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN ~RCOS, TEXAS, AMENDING THE CODE OF ORDINANCES OF SAID CITY TO ADD A SECTION 2-5 TO ESTABLISH A FEE IN THE AMOUNT OF TEN DOLLARS ($10.00) TO BE ASSESSED AGAINST PERSONS SUBMITTING CHECKS TO SAID CITY WHICH ARE RETURNED TO SAID CITY BECAUSE OF THE REFUSAL OF THE PAYOR FINANCIAL INSTITUTION TO PAY THE ITEM AS DRAWN AND ESTABLISHING AN EFFECTIVE DATE.
