Regular Meeting <br /> <br />May 11, 1981 <br /> <br /> 42 <br />Page 3 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING CHAPTER 12, ENTITLED "GARBAGE <br />AND TRASH", OF THE CODE OF ORDINANCES OF SAID CITY TO <br />INCLUDE A NEW SECTION REQUIRING A DEPOSIT TO OBTAIN <br />GARBAGE SERVICE FROM SAID CITY WHEN CITY UTILITY SER- <br />VICE IS NOT PROVIDED TO THE SAME SITE AND SETTING THE <br />AMOUNT OF SAID DEPOSIT FOR DIFFERENT TYPES OF SERVICE <br />AND DECLARING AN EMERGENCY. <br /> <br />This Ordinance was considered on emergency basis. Mrs. Norris moved <br />to adopt the Ordinance and Mr. Kreczmer seconded the motion, which <br />passed unanimously. <br /> <br />Mr. James introduced for consideration an Ordinance to amend Ordinance <br />1980-37, which sets forth expense of conducting each department of the <br />City for the fiscal year beginning October 1, 1980. Also considered <br />in conjunction with this Ordinance was the acceptance of bids of a <br />sideloader and cannisters. The Ordinance was read in its entirety, <br />having the following caption: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING ORDINANCE 1980-37, ADOPTED <br />SEPTEMBER 8, 1980, WHICH SET FORTH AN ITEMIZED ESTI- <br />MATE OF THE EXPENSE OF CONDUCTING EACH DEPARTMENT, <br />DIVISION AND OFFICE OF THE MUNICIPAL GOVERNMENT OF <br />SAID CITY FOR THE FISCAL YEAR BEGINNING OCTOBER 1, <br />1980 AND ENDING ON SEPTEMBER 30, 1981 AND APPRO- <br />PRIATED MONEY FOR THE VARIOUS FUNDS AND PURPOSES OF <br />SUCH ESTIMATE TO REVISE SAID ESTIMATES AND TO REAP- <br />PROPRIATE SAID FUNDS ADOPTING SAID REVISIONS AND <br />ESTIMATES AND DECLARING AN EMERGENCY. <br /> <br />This Ordinance was considered on an emergency basis. Mrs. Norris <br />moved to adopt the Ordinance and Mrs. Mendez seconded the motion, <br />which passed unanimously. <br /> <br />It was necessary to amend Ordinance 1980-37 in order to consider the <br />purchase of the sideloader and cannisters. <br /> <br />Mr. James then introduced for consideration the acceptance of bids <br />of a sideloader and cannisters. Mr. James moved to accept the bid <br />to purchase a diesel sideloader and cannisters and Mr. Cavazos se- <br />conded the motion, which passed unanimously. <br /> <br />Mr. James introduced for consideration a public hearing to consider <br />amending the General Zoning Ordinance to require conditional use per- <br />mit rather than specific use permit for bars, nightclubs and taverns <br />located in light industrial districts and bars and nightclubs located <br />in commercial districts in the City. No one spoke in favor of the <br />amendment and two men opposed any more bars of any kind being allowed <br />to open in San Marcos. After much discussion the matter was tabled <br />until the Staff could make a report stating the current conditions <br />that are stipulated and with the direction of Mr. Craig Farmer what <br />areas might be stiffened to avoid further problems. Mrs. Norris <br />moved that the Ordinance be tabled and Mrs. Mendez seconded the mo- <br />tion, which passed unanimously. <br /> <br />Mr. James introduced for consideration an ©rdinance on first reading, <br />which was read in its entirety, having the following caption: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />~RCOS, TEXAS, AMENDING THE CODE OF ORDINANCES OF <br />SAID CITY TO ADD A SECTION 2-5 TO ESTABLISH A FEE IN <br />THE AMOUNT OF TEN DOLLARS ($10.00) TO BE ASSESSED <br />AGAINST PERSONS SUBMITTING CHECKS TO SAID CITY WHICH <br />ARE RETURNED TO SAID CITY BECAUSE OF THE REFUSAL OF <br />THE PAYOR FINANCIAL INSTITUTION TO PAY THE ITEM AS <br />DRAWN AND ESTABLISHING AN EFFECTIVE DATE. <br /> <br /> <br />
