~ :::c L~ co-, ~ The City Manager explained that an easement had been obtained by the private water company owning the water distrubution system in 1883 Across 'Lots 1 & 2, Block 3, Enoch Moore Addition. This easement was no longer being used and would have no value to the City in the future. The College has bought Lot 2 and the easement creates a cloud on the title of the lot. It was recommended that the easement be abandoned. Alderman Hillburn introduced an ordinance entitled: AN ORDINANCE RELEASING A CERTAIN WATER LINE EASEMENT, AND ALL OTHER RIGHTS, TITLE AND INTEREST OF THE CITY OF SAN MARCOS, IN AND TO LOT NO. TWO (2) IN BLOCK NO. THREE (3) AND ADJOINING PROPERTY IN THE ENUCH MOORE ADDITION TO THE CITY OF SAN MARCOS UNTO B. L. DAILEY AND WIFE, AND AUTHORIZING THE W~YOR TO EXECUTE AN INSnUMENT OF RELEASE I The ordinance was read in full and the motion of adoption was seconded by Alderman Younger. Upon roll call the ayes and nays were as follows: AYES, Allen, Hillburn, Korff, Ruiz, Sutton, and Younger NAYS: None Whereupon Mayor Allen declared the ordinance passed, approved and adopted. The City Manager advised the Council that Mrs. Judy B. Tomlinson had resigned her position as Tax Assessor-Collector and City Secretary effective as of August 31, 1961. The City Manager had employed Mr. George C. Reed as Acting Tax Assessor-Collector and City Secretary at a salary of $375.00 per month pending the approval of the Council. Alderman Younger introduced an ordinance entitl ed: AN ORDINANCE APPOINTING GEORGE C. REED AS TAX ASSESSOR-COLLECTOR AND CITY SECRETARY; SETTING THE COMPENSATION; REVOKING ANY ORDINANCES IN CONFLICT HEREWITH; AND, ESTABLISHING AN EFFECTIVE DATE. I and moved its adoption. The ordinance was read in full and the motion of adoption was seconded by Alderman Hillburn. Upon roll call the ayes and nays were as follows> AYES I Allen, Hillburn, Korff, Ruiz, Sutton, and Yqunger NAYS: None Whereupon the Mayor declared the motion passed, approved and adopted. The City Manager explained that Mr. Otis Gary, who lives outside the city limits, had requested that a 2" water line be ex- tended to serve his residence and the old F. A. Riley place, The cost of the water line to be borne by the two property owners. The Council was reminded of its policy of not extending utility service to customers outside the corporate limits. Alderman Sutton made a motion that the water line be extended to N~. Gary with all expenses being paid by the property owners served. The motion died for want of a second. Alderman Korff made a motion that Mr. Gary and the adjacent property owners be asked if they would like to petition the City to be brought within the city limits in which case the City would install an adequate water line and fire protection provided the taxes received from the property so incorporated would amount to a sum equal in five years to the I
