<br />~ <br />:::c <br />L~ <br />co-, <br />~ <br /> <br />The City Manager explained that an easement had been obtained <br />by the private water company owning the water distrubution system in <br />1883 Across 'Lots 1 & 2, Block 3, Enoch Moore Addition. This easement <br />was no longer being used and would have no value to the City in the <br />future. The College has bought Lot 2 and the easement creates a cloud <br />on the title of the lot. It was recommended that the easement be <br />abandoned. Alderman Hillburn introduced an ordinance entitled: <br /> <br />AN ORDINANCE RELEASING A CERTAIN WATER LINE <br />EASEMENT, AND ALL OTHER RIGHTS, TITLE AND <br />INTEREST OF THE CITY OF SAN MARCOS, IN AND <br />TO LOT NO. TWO (2) IN BLOCK NO. THREE (3) <br />AND ADJOINING PROPERTY IN THE ENUCH MOORE <br />ADDITION TO THE CITY OF SAN MARCOS UNTO B. L. <br />DAILEY AND WIFE, AND AUTHORIZING THE W~YOR <br />TO EXECUTE AN INSnUMENT OF RELEASE <br /> <br />I <br /> <br />The ordinance was read in full and the motion of adoption was seconded <br />by Alderman Younger. Upon roll call the ayes and nays were as follows: <br /> <br />AYES, Allen, Hillburn, Korff, Ruiz, Sutton, and Younger <br /> <br />NAYS: None <br /> <br />Whereupon Mayor Allen declared the ordinance passed, approved and <br />adopted. <br /> <br />The City Manager advised the Council that Mrs. Judy B. <br />Tomlinson had resigned her position as Tax Assessor-Collector and <br />City Secretary effective as of August 31, 1961. The City Manager <br />had employed Mr. George C. Reed as Acting Tax Assessor-Collector <br />and City Secretary at a salary of $375.00 per month pending the <br />approval of the Council. Alderman Younger introduced an ordinance <br />entitl ed: <br /> <br />AN ORDINANCE APPOINTING GEORGE C. REED AS TAX <br />ASSESSOR-COLLECTOR AND CITY SECRETARY; SETTING <br />THE COMPENSATION; REVOKING ANY ORDINANCES IN <br />CONFLICT HEREWITH; AND, ESTABLISHING AN <br />EFFECTIVE DATE. <br /> <br />I <br /> <br />and moved its adoption. The ordinance was read in full and the <br />motion of adoption was seconded by Alderman Hillburn. Upon roll <br />call the ayes and nays were as follows> <br /> <br />AYES I Allen, Hillburn, Korff, Ruiz, Sutton, and <br /> <br />Yqunger <br /> <br />NAYS: None <br /> <br />Whereupon the Mayor declared the motion passed, approved and <br />adopted. <br /> <br />The City Manager explained that Mr. Otis Gary, who lives <br />outside the city limits, had requested that a 2" water line be ex- <br />tended to serve his residence and the old F. A. Riley place, The <br />cost of the water line to be borne by the two property owners. <br />The Council was reminded of its policy of not extending utility <br />service to customers outside the corporate limits. Alderman <br />Sutton made a motion that the water line be extended to N~. Gary <br />with all expenses being paid by the property owners served. The <br />motion died for want of a second. Alderman Korff made a motion <br />that Mr. Gary and the adjacent property owners be asked if they <br />would like to petition the City to be brought within the city <br />limits in which case the City would install an adequate water line <br />and fire protection provided the taxes received from the property <br />so incorporated would amount to a sum equal in five years to the <br /> <br />I <br />
