-88- ')g It was brought to the attention of the Council that at the Regular Meeting of October 10, 1961 an ordinance had been adopted in- advertently inasmuch as the portions of the Ordinance setting forth that the Sary Marcos Baptist had petitioned the city for the construc- tion of said Moore Street and offered the right-of-way need for the needed alteration, had been .omitted as an exhibit and had, in fact, not been executed by the president of the Board of Trustees of the Academy although it had been accepted by the Board. Alderman Hillburn moved that the Ordinance entitled: AN ORDINANCE VACATING, CLOSING AND ABANDONING A PORTION CF MOORE STREET; CONVEYING SAID PORTION OF MOORE STREET TO THE SAN MARCOS BAPTIST ACADEMY IN EXCHANGE FOR THE CONSTRUCTION OF A STREET TRAVERSING A PORTION OF MOORE STREET AND SAID REAL PROPERTY TO BE CONVEYED TO THE CITY OF SAN MARCOS BY SAID ACADEMY. be rescinded. - The motion was seconded by Alderman Korff and upon roll call the ayes and nays were as follows: Ayes: Allen, Hillburn, Korff, Ruiz, Sutton, and Younger. "Nays: None Alderman Hillburn "then introduced an Ordinance, complete with a properly executed Petition from the San Marcos Baptist Academy -and a Deed of Conveyance of 0.58 acres of land for the extention of Moore Street, and moved its adoption. The Ordinance was read in full. The Ordinance is captioned:' AN ORDINANCE VACATING, CLOSING AND ABANDONING A PORTION Cf MOORE STREET; CONVEYING SAID PORTION OF MOORE STREET TO THE SAN MARCOS BAPTIST ACADEMY IN EXCHANGE FOR THE CONSTRUCTION OF A STREET TRAVERSING A PORTION OF MOORE STREET AND SAID REAL PROPERTY TO BE CONVEYED TO THE CITY OF SAN MARCOS BY SAID 'ACADEMY ~ Alderman Korff seconded the motion of adoption. Upon roll call, the Ayes and Nays were as follows, Ayes: Allen, Hillburn, Korff, Ruiz, Sutton, and younger. Nays: None Whereupon Mayor Allen declared the Ordinance Passe, Approved, and Adopted and the Deed of Conveyance of 0.58 of land for the construc- tion of Moore Street from Smith Avenue to Grace Street accepted. The City Manager presented for the Councilts approval a schedule of the Prevailing Wage Rates which would he "included in the specifications for the relocation of utilities on th~ construction section of Interstate 35 within the city limits and represented the minimum wage which the contractors bidding on the job would be re- quired to pay. On motion of Alderman Sutton and seconded by Alderman Ruiz, the schedule was approved upon unaminous vote of the Council. The final Engineer's estimate of the construction cost of the relocation of all the work including the lift station relocation, was estimated to he $148,469.52. The Cityts portion of the construc- tion cost was estimated to be 7.67% of the hid cost. Upon motion of Alderman Sutton; seconded by Alderman Korff and passedhy the unami- nous vote of the Council this percentage estimate was approved. The City Manager was authorized to forward a letter to the Highway Department stating that the Engineerts Plans and Specifi- cations contained all the items to be included within the .contracts (including the lift station to be let at a later date) except the i~em of inspection which would be determined later. The Council considered a request from the State Highway Department that. the new right-of-way from the MKT RR spur to ,Lockhart to the 'north end of Project 135-3(35)204 be incorporated within the city limits in order that the entire project would he considered an urhan section and would facilitate lighting, utility relocation and other matters.
