<br />-88- ')g <br /> <br />It was brought to the attention of the Council that at the <br />Regular Meeting of October 10, 1961 an ordinance had been adopted in- <br />advertently inasmuch as the portions of the Ordinance setting forth <br />that the Sary Marcos Baptist had petitioned the city for the construc- <br />tion of said Moore Street and offered the right-of-way need for the <br />needed alteration, had been .omitted as an exhibit and had, in fact, <br />not been executed by the president of the Board of Trustees of the <br />Academy although it had been accepted by the Board. Alderman Hillburn <br />moved that the Ordinance entitled: <br />AN ORDINANCE VACATING, CLOSING AND ABANDONING A PORTION <br />CF MOORE STREET; CONVEYING SAID PORTION OF MOORE STREET <br />TO THE SAN MARCOS BAPTIST ACADEMY IN EXCHANGE FOR THE <br />CONSTRUCTION OF A STREET TRAVERSING A PORTION OF MOORE <br />STREET AND SAID REAL PROPERTY TO BE CONVEYED TO THE CITY <br />OF SAN MARCOS BY SAID ACADEMY. <br />be rescinded. - The motion was seconded by Alderman Korff and upon <br />roll call the ayes and nays were as follows: <br />Ayes: Allen, Hillburn, Korff, Ruiz, Sutton, and Younger. <br />"Nays: None <br /> <br />Alderman Hillburn "then introduced an Ordinance, complete <br />with a properly executed Petition from the San Marcos Baptist Academy <br />-and a Deed of Conveyance of 0.58 acres of land for the extention of <br />Moore Street, and moved its adoption. The Ordinance was read in full. <br />The Ordinance is captioned:' <br />AN ORDINANCE VACATING, CLOSING AND ABANDONING A PORTION <br />Cf MOORE STREET; CONVEYING SAID PORTION OF MOORE STREET <br />TO THE SAN MARCOS BAPTIST ACADEMY IN EXCHANGE FOR THE <br />CONSTRUCTION OF A STREET TRAVERSING A PORTION OF MOORE <br />STREET AND SAID REAL PROPERTY TO BE CONVEYED TO THE CITY <br />OF SAN MARCOS BY SAID 'ACADEMY ~ <br />Alderman Korff seconded the motion of adoption. Upon roll call, the <br />Ayes and Nays were as follows, <br />Ayes: Allen, Hillburn, Korff, Ruiz, Sutton, and younger. <br />Nays: None <br />Whereupon Mayor Allen declared the Ordinance Passe, Approved, and <br />Adopted and the Deed of Conveyance of 0.58 of land for the construc- <br />tion of Moore Street from Smith Avenue to Grace Street accepted. <br /> <br />The City Manager presented for the Councilts approval a <br />schedule of the Prevailing Wage Rates which would he "included in the <br />specifications for the relocation of utilities on th~ construction <br />section of Interstate 35 within the city limits and represented the <br />minimum wage which the contractors bidding on the job would be re- <br />quired to pay. On motion of Alderman Sutton and seconded by Alderman <br />Ruiz, the schedule was approved upon unaminous vote of the Council. <br /> <br />The final Engineer's estimate of the construction cost of <br />the relocation of all the work including the lift station relocation, <br />was estimated to he $148,469.52. The Cityts portion of the construc- <br />tion cost was estimated to be 7.67% of the hid cost. Upon motion of <br />Alderman Sutton; seconded by Alderman Korff and passedhy the unami- <br />nous vote of the Council this percentage estimate was approved. <br /> <br />The City Manager was authorized to forward a letter to <br />the Highway Department stating that the Engineerts Plans and Specifi- <br />cations contained all the items to be included within the .contracts <br />(including the lift station to be let at a later date) except the <br />i~em of inspection which would be determined later. <br /> <br />The Council considered a request from the State Highway <br />Department that. the new right-of-way from the MKT RR spur to ,Lockhart <br />to the 'north end of Project 135-3(35)204 be incorporated within the <br />city limits in order that the entire project would he considered an <br />urhan section and would facilitate lighting, utility relocation and <br />other matters.
