~`
-2-
Among other holdings, Robinson vs. Hays stands for the proposi-
tion that Article 1007 allows the mayor to vote ONLY in case of a tie
where membership of the city council is in contest. Among other holdings,
City of Centerville vs. Adkinson stands for the proposition that the
"casting vote E' to which the mayor is entitled by Article 1007 is a
vote ONLY in the event of a tie.
It is my opinion, in view of the above-cited statutes and cases,
and I have found no authorities contrary thereto, that the mayor's
voting right on any question coming before the City Council is limited
to such issue as results in a tie vote among the councilmen. The mayor,
however, may veto any resolution or ordinance passed by the Council,
under the authority of Article 997.
Respectfully submitted,
Albert M. Walker
cc: Mr. H.
