<br />I <br /> <br />I <br /> <br />I <br /> <br />~: <br />'1 ~"".' <br />10, <br /> <br />~ <br />174 <br /> <br />AN ORDINANCE REGULATING AND LICENSING THE KEEPING OF DCXiS <br />WITHIN THE CITY LIMITS OF SAN MARCOS; PROVIDING FOR A LICENSE <br />FEE; VACCINATION AGAINST RABIES; ISSUANCE BY THE TAX aSSESSID~- <br />COLLECTOR OF A LICENSE TAG AFTER VACCINATION; ISSUANCE OF <br />DUPLICATE FOR LOST TAGS; MAKING IT UNLAWFUL TO KEEP AN UNLIC- <br />ENCED DOG; APPOINTING A POUND MASTER; REQUIRING MONTHLY REPORTS; <br />EstABLISHING POUND FEES; PERMITTING REDEMPTION 'OF" IMPOUNDED <br />DOGS; PRESCRIBING DISPOS,ITION OF, UNCLAIMED DOOS; "UNLAWFUL TO , , <br />REMOVE L!CENSE TAG; RESTRAINING FEMALE DOGSDURING9-VUl.I.TION;OES" i'?US; <br />PROHm IT ING "DUMPING" Da:;S WITHIN CITY LIMITS; }lfGULATING CON- <br />FINEMENT OF DOGS UNDER CERTAIN CONDITIONS; UNLi\WFUL TO KEEP <br />HOGS; REpULAT~ON OF CATTLE, HORSES, FOW1.S, ETC.; PROVIDING A <br />SAVINGS CLAUSE'; MAKING VIOLATION A MISDEMEANOR; REPEALING <br />ORDINANCES IN CONFLICT; AND, PROVIDING" AN EFFECTIVE DATE OF <br />ENFORCEMENT . <br /> <br />BE IT ORDAINED by the' Governing Body of. the City of San Marcos, that: <br /> <br />Section 1. LICENSE FEE. There is hereby fixed and assessed as a <br />police regulation for the protection of the public health a license fee of <br />ONE DOLLAR ($l.OO)"per annum against the owner or keeper of each and every <br />dog kept in the City of San Marcos. The license shall run from August first <br />of each year to July thirty-first of the succeeding year, and any part of <br />such year be deemed, and considered the entire year". " <br /> <br />Section 2. VACCINATI6N AGAINST RABIES. It shall be the duty of <br />the owner or keeper"of each and every dog, kept in"the City of San Marcos <br />to'have such dog vaccinated a~ainst rabies bya ptacticing veterinariat) at <br />least once'''each year! provide9, however, that such dog mu:;t have been vac- <br />"cinated within one month of tile date the owner or keeper1-i; application for <br />the license as herein required.:> ' <br /> <br />t <br /> <br />Section 3, LICEN~E TAG. It shall be t~e duty'~f the City Tax <br />Assessor-Collector to provide sui~abl~ metal tags for said dogs, which tags <br />'shall evidence the payment of the license fee and the registration of said <br />dog. Each person owning or keeping a dog within the limits of the City of <br />San M~rcos shall apply to the City Tax Ass~ssor-collectQr'for a tag, and <br />upon payment'of said license fee and presentation of a tertificate by a <br />practicing veterinarian showing that said dog ,has within one month of the <br />date' of application for license beee vaccinated against rabies, the Tax <br />Assessor~Collectorshall supply"to each applicant a tag suitable to be <br />fastened upon a collar around the'dog's neck, and shall keep in a book <br />kept for such purpose, register the number of said tag, the name and ad- <br />dress of the owner or keeper of the dog, and a description of said dog, <br />and no license shall be issued unless the application ~s accompanied by <br />such veterinarian's certificate. It shall he the duty of\the owner or <br />keeper of each dog to apply to said officer for such license, pay the fee <br />" forisame, and obtain a tag therefor, "and to have and to keep said tag at <br />all times during the year securely fastened around the neck of said dog, <br />and the failure of the owner in this respect shall have the same effect as <br />if no license had ,been paid u~on said dog. <br /> <br />Section 4. LOST 'TAGS. It shall he the duty of ,the owner or <br />keeper of any dog to procure a duplicate tag from the City Tax Assessor- <br />Collector in the event that the original tag is lost or distroyed and the <br />Tax Assessor-Collector shall issue a duplicate tag upon application <br />of any person who has complied with the provisions of this ordinance and <br />upon payment 0"fT fFfty cents (5bO to cover the cost of issuing the, 'dup- <br />licate tag." , ' <br /> <br />Section 5. UNLAWFUL TO KEEP. It shall' be unlawful for any <br />person to keep any dog in the limits of the City of San Marcos for which <br />the license herein provided has not been procured from the Tax Assessor- <br />collec~or, and which'" has not beten, vaccfnated for rabies and' upon ,,!'Ihich the <br />tag herein above provided ror is not at all times fastened around the neck <br />of sUch dog. <br /> <br />Section 6. -POUND MASTER. The City M'anager shall appoint a <br />special officer to be known and describ,ed as the Pound Master and fix <br />a salary" thereror," subject to,the approval of the Governing Body, and the <br />City Manager may appoint or provide for an assistant or assistants to the <br />Pound Master.
