<br /> <br />~D <br /> <br />i <br />I <br />I <br />l <br /> <br />Adjourned regular meeting September 19, 1962 <br /> <br />page 2 <br /> <br />1. <br /> <br />That the aforesaid election was duly and legally called and notice <br />thereof given in accordance with the laws of the State of Texas and the <br />Special Urban Renewal Election Ordinance of the City of San Marcos calling <br />said election; and that said election was held in strict conformity with the <br />Constitution and laws of the State of Texas and the returns thereof have been <br />properly made to the officials of the City entitled to receive same; that only <br />qualified voters residing in the City of San Marcos, Texas, owning taxable <br />property within the boundaries thereof, who have duly rendered the same for I <br />taxation, were permitted to vote at said election and further that said <br />election properlY represents the desires of those qualified to vote as <br />aforesaid. <br /> <br />ll. <br /> <br />That the proposition for the adoption by the City Council of an Urban <br />Renewal Resolution under and pursuant to the Urban Renewal Law of Texas <br />was sustained by a majority of the qualified voters of the City of San <br />Marcos, Texas, voting at said election who owned taxable property within <br />the boundaries of said city and who have duly rendered the same for taxation; <br />and that the City Council of the City of San Marcos is hereby authorized <br />to adopt an Urban Renewal Resolution under and pursuant to the Urban Renewal <br />Law of Texas substantially in the form as set forth in the notice of public <br />hearing to consider the question of whether said election would. be called <br />and substantially as set forth in the form of ballot prescribed for said <br />election by Special Urban Renewal Election Ordinance of the City of San Marcos. <br /> <br />After discussion, Councilman Younger moved the adoption of the Resolution <br />as introduced and read, and Councilman Ruiz seconded the motion. On roll <br />call the fOllowing vote was recorded; <br /> <br />AYEs Moore, Ruiz, Stokes, Swift and Younger <br /> <br />NAY: None <br /> <br />I <br /> <br />Thereupon the Mayor declared the resolution duly PASSED AND APPROVED. <br /> <br />The fOllowing resolution was introduced by Council Younger, read in full <br />and considered I <br /> <br />) <br /> <br />"RESOLlITION MAKING CERTAIN FINDINGS, DETERMINATIONS <br />AND ELEGrIONS UNDER AND PURSUANT TO THE URBAN <br />RENEWAL LAW OF TEXAS. <br /> <br />WHEREAS, the City Council by Resolution on June 12, 1962, ordered that <br />notice of public hearing to be held on August 14, 1962, be published in <br />the June 14, 1962 and .June 21, 1962 issues of THE SAN MARCOS RECORD, the <br />official newspaper of the City of San Marcos, the purpose of said public <br />hearing being to consider wnether or not the City Council would order an <br />election by the q~alified voters of the City of San Marcos to determine <br />whether said voters approved the passage by the City Council of an Urban <br />Renewal Resolution substantially as set forth in the body of this <br />Resolution; and <br /> <br />V<HEREAS, said notices were duly published in THE SAN MARCOS RECORD in <br />San Marcos, Texas, and said public hearing was duly convened in City Hall, <br />San Marcos, Texas, by the City Council. at 7s30 P.M., C.S.!., on August 14, I <br />1962 and the City Council determi ned that said election should be ordered <br />to be held on September 18, 1962, from 8s00 A.M. to 7:00 P.M., C.S.T. in <br />the Ci tyof San Marcos, Texas, said determination being made after all <br />persons present at said public hearing were given an opportunity to speak <br />for and against the proposal; and <br /> <br />WHEREAS, said election was duly held in the City of San Marcos, Texas, <br />on September 18, 1962, and after caovassing the votes of said election, <br />
