't'rl ~., 57 AN ORDINANCE ESTABLISHING HOURS THE SAN MARCOS CEMETERY WILL BE OPEN TO THE PUBLIC: MAKING IT A MISDEMEANOR TO BE IN THE CEMETERY DURING CLOSED HOURS; ESTABLISHING A SAYINGS CLAUS!;: AND, DESIGNATING AN EFFECTIVE DATE I WHEREAS, it has come to the attention of the City Counci I that considerable vandalism and desecration has occured in the San Marcos Cemetery during the nighttime, and, WHEREAS, it is believed that the interest of the public would be best served by the establishment of hours when the San Marcos Cemetery will be offically open to the publi c. NOW, THEREFORE, BE IT ORDAINED by the Governing Body of the City of San Marcos, Texas, Hut: Section I The San Marcos Cemetery will be officially open for visiting, care of graves, services for the burial of the dead and other appropriate uses from 7:00 o'clock A.M., CST, unti I dusk (one-half hour after offi cial sundown). Section 2 Any person loitering or otherwise found in the Cemetery when the said cemetery is officially closed as set forth in Section I above, without the written permission of the Cemetery Superin- tendent, shall be deemed guilty of a misdemeanor and, upon con- viction, shall be fined not less than One Dollar ($1.00) nor more than Two Hundred Dollars ($200.00). I Section 3 If. any word, phrase, clause, sentence or section of this ordinance shall be found unconstitutional or invalid by a court of competent jurisdiction, it shall not impair or invalidate the remaining portions thereof. Section 4 This ordinance shall be in full force and effect upon the date of its legal publication, or the 15th day of October 1962 whichever shall occur last.
