<br />regular meeting march 12 page three <br /> <br />2-~ <br /> <br />"' After some discussion, Mr. Bunting requested the Council to <br />accept whatever right, title or interest he might have in the lines <br />and that they be considered the property of the City. Mr. Bunting <br />further agreed that he would not make any further charges for connect- <br />ions to the line and the City agreed that the City would continue to <br />provide adequate service to the customers presently connected to the <br />line. Any further connections would be in accordance with Council <br />policy regarding outside connections in effect at the time the request <br />was made.' <br /> <br />I <br /> <br />"A problem has arisen regarding this matter. Quite some time ago, <br />Mr. Eugene Sm.th, Austin, Texas, paid for a tap and made a deposit for <br />water for Lot 5 of the Fairlawn Addn. He used the water for stock. <br />Later, a relative of his built a house on Lot 4 and he permitted this <br />building to be connected to his line behind the meter. Later he dis- <br />continued usimg water but the bill was paid by his relative. Later that <br />year (1961) Mr. Bunting asked that the meter be moved down in front of <br />the house on Lot 4. Mr. Smith believes that the tap belongs to him and <br />was in favor of leaving the meter and tap 'as is'. The property has <br />now been sold to Mr. Twilley, and the house (on Lot 4) is still using <br />the meter and tap Jocated at Lot 5. Mr. Twilley has an opportunity <br />to sell the house but wants assurance that he will be able to promise <br />the buyer that he will continue to receive City water. Mr. Smith, <br />on the other hand, does not want to lose the possibility of, his not <br />being able to get water. <br /> <br />"This problem is quite involved and results from not adequately <br />controlling utility extensions outside the City Limits." <br /> <br />A thorough discussion ensued on a fair solution to the complicated <br />situation. Alderman Moore moved that Mr. J.B. Twilley be allowed <br />a water tap if the line was extended to a point specified by the City <br />and all costs paid by Mr. Twilley. Alderman Stokes seconded the motion, <br />which carried unanimously. <br /> <br />I <br /> <br />The City Manager repOrted that the radar unit for the Police Department <br />had been received, and application made to FCC for a permit to place <br />it in operation. He stated its use should result in better enforcement <br />of speed ordinances. The City Manager also reported that the traffic <br />signal at Guadalupe and Comal Streets had been installed. <br /> <br />The meeting adjourned at 8127 <br /> <br />p.m.,(~-to econve~e at 7 p.m., <br /> <br />(\ <br />J .
