<br />regular meeting, may 14, 1963 <br /> <br />page five <br /> <br />~ <br /> <br />t. c~t <br /> <br />Whereupon, the Mayor declared the motion had failed to pass. <br /> <br />A tequest from Charles A. Zunker was presented to the Council by <br />his attorney. Alderman Pool moved the enactment of an ordinance <br />deeding Mr. Zunker an unused alleyway, subject to a review of the <br />matter by the City Attorney. Alderman Moore seconded the motion, <br />and on roll call, the following vote was recorded: <br /> <br />I <br /> <br />AYE; <br />NAY: <br />ABsrA1N1NG: <br /> <br />Moore, Pool, Ruiz, Swift <br />None <br />Stokes <br /> <br />Whereupon, the Mayor declared the Ordinance Passed, Approved and Adopted. <br /> <br />Alderman Stokes introduced the possibility of the Local Public Agency <br />acquiring the St. John's Catholic Church property, and stated he wished <br />"to go on public record as being opposed now and at any future time to <br />suchan action". He read the following statement: <br /> <br />I <br /> <br />"I have been informed that the San Marcos Local Public Agency <br />is considering the possibility of adding St. John's Catholic <br />Chwrch and its parochial school to the area to be acquired by <br />the LPA for the college expansion program. <br />"This has given me considerable worry, since the City Council <br />promised the people of San Marcos at the inception that this <br />program could be accomplished without an increase in taxes or <br />a bond issue. <br />"I consider the area and the program delineated by the Council <br />at its inception as the maximum possible under this program <br />with the accrued credits that the City has to offset the City's <br />25% share of costs. To include the Church at this time, I am <br />convinced, would cause the LPA to have to materially reduce the <br />scope of this program in the river area, or the City would have <br />to have a bond issue tp raise its share of the cost. <br />"1, therefore, wish to go on record, publically, as being oppos- <br />ed to the inclusion of the Catholic Church in the program at <br />this time, and 1 wish to call upon the LPA to cease spending <br />any public funds toward that end." <br /> <br />Mayor Taylor stated that he concurred in everything that Mr. Stokes <br />had said. A general discussion of the subject ensued. <br /> <br />Alderman Ruiz reported that he had been working with Attorney Henry <br />Kyle on procuring easements for public streets in the Cruz Partition. <br /> <br />Alderman Swift moved that the Council take a ten minute recess before <br />going into executive session. Alderman Stokes seconded the motion, <br />which passed unanimously. <br /> <br />EXECtJrIVE SESSION <br /> <br />Alderman Swift moved the enactment of an Ordinance naming Kenneth <br />Sutton as Court Recorder. The Ordinance, which ~as read in full, <br />is captioned as followsl <br /> <br />I <br /> <br />AN ORDINANCE APPOINTING A RECORDER OF IHE CORPORATION COURT; <br />AtJrHORIZING THE CUY SECRETARY TO APPOINT A DEPtJrY SECRETARY <br />WHO SHALL BE EX-OFFICIO CLERK OF SAID COURT; FIXING THEIR <br />TERMS OF OFFICE, COMPENSATION AND DtJrIES <br /> <br />Alderman Ruiz seconded the motion of adoption and on roll call <br />the following vote was recorded: <br /> <br />AYE: Moore, Pool, Ruiz, Stokes, Swift <br />NAY; None <br /> <br />Whereupon, the Mayor declared the Ordinance Passed, Approved and Adopted. <br /> <br />'h~"(. ~ ~ <br />Ir"Jl:' <br />
