<br />I cf <br /> <br />~ <br /> <br />)1/ <br /> <br />I <br /> <br />AN ORDINANCE CREATING THE CITY OF SAN MARCOS, <br />TEXAS, ZONING COMMISSIG<; DESIGNATING THE <br />PLANNING COMMISSIG< TO ACT AS THE PLANNING AND <br />ZONING COMMISSIG<; REQUIRING A PRELIMINARY REPORT <br />AND PUBLIC HEARINGS; AND, DESIGNATING THE REGULATIONS <br />SHALL BE IN ACCORDANCE WITH A COMPREHENSIVE MAsrER PLAN <br /> <br />WHEREAS, it has been brought to the attention of the Governing Body <br />of the City of San Marcos, Texas, that the creation of a zoning <br />commission is a public necessity for the promotion of health, safety <br />and morals of the citizens of San Marcos; and, <br /> <br />WHEREAS, the preservation of the community's general welfare is of <br />paramount importance and it is believed that this may best be accomp- <br />lished by the Governing Body availing itself of the power granted it <br />under the Statutes to regulate and restrict the height, number of stories, <br />and size of buildings and other structures, the percentage of lot that <br />may be occupied, the size of the yards, courts, and other open spaces, <br />the density of population, and the location and use of buildings, struct- <br />ures and land for trade, industry, residence, or other purposes; and, <br />in the case of designated places and areas of historical and cultural <br />importance, to regulate and restrict the construction, alteration, recon- <br />struction, or razing of buildings and other structures, <br /> <br />NOW, THEREFORE, BE IT ORDAINED by the Governing Body of the City of <br />San Marcos, Texas, as follows: <br /> <br />I <br /> <br />SECTION I In order to effectively carry out the necessary <br />requirements, there is hereby created the CITY OF SAN MARCOS <br />ZONING COMMISSION. <br /> <br />SECTION 2 Statutory provisions permit the City's planning <br />commission to act in this capacity, where a planning commission <br />is in existence. The City of San Marcos PLANNING COMMISSION <br />is hereby vested with all applicable statutory authority and <br />is designated to act as the City of San Marcos PLANNING AND <br />ZONING COMMISSION. <br /> <br />SECT ION 3 The PLANNING AND ZONING COMMISSION shall make a <br />preliminary report for submission to the Governing Body. It <br />shall hold such public hearings as may be required prior to <br />submitting its final report for approval and acceptance by <br />the Governing Body according to law. <br /> <br />SECTION 4 The PLANNING AND ZONING COMMISSION shall assure <br />itself that the regulations submitted are made in accordance <br />with a comprehensive plan.
