I cf ~ )1/ I AN ORDINANCE CREATING THE CITY OF SAN MARCOS, TEXAS, ZONING COMMISSIG<; DESIGNATING THE PLANNING COMMISSIG< TO ACT AS THE PLANNING AND ZONING COMMISSIG<; REQUIRING A PRELIMINARY REPORT AND PUBLIC HEARINGS; AND, DESIGNATING THE REGULATIONS SHALL BE IN ACCORDANCE WITH A COMPREHENSIVE MAsrER PLAN WHEREAS, it has been brought to the attention of the Governing Body of the City of San Marcos, Texas, that the creation of a zoning commission is a public necessity for the promotion of health, safety and morals of the citizens of San Marcos; and, WHEREAS, the preservation of the community's general welfare is of paramount importance and it is believed that this may best be accomp- lished by the Governing Body availing itself of the power granted it under the Statutes to regulate and restrict the height, number of stories, and size of buildings and other structures, the percentage of lot that may be occupied, the size of the yards, courts, and other open spaces, the density of population, and the location and use of buildings, struct- ures and land for trade, industry, residence, or other purposes; and, in the case of designated places and areas of historical and cultural importance, to regulate and restrict the construction, alteration, recon- struction, or razing of buildings and other structures, NOW, THEREFORE, BE IT ORDAINED by the Governing Body of the City of San Marcos, Texas, as follows: I SECTION I In order to effectively carry out the necessary requirements, there is hereby created the CITY OF SAN MARCOS ZONING COMMISSION. SECTION 2 Statutory provisions permit the City's planning commission to act in this capacity, where a planning commission is in existence. The City of San Marcos PLANNING COMMISSION is hereby vested with all applicable statutory authority and is designated to act as the City of San Marcos PLANNING AND ZONING COMMISSION. SECT ION 3 The PLANNING AND ZONING COMMISSION shall make a preliminary report for submission to the Governing Body. It shall hold such public hearings as may be required prior to submitting its final report for approval and acceptance by the Governing Body according to law. SECTION 4 The PLANNING AND ZONING COMMISSION shall assure itself that the regulations submitted are made in accordance with a comprehensive plan. Such regulations shall be made with reasonable consideration, among other things, to the character of the district and its peculiar suitability for particular uses, and with a view to conserving the value of buil dings and encouraging the most appropriate use of land throughout the City of San Marcos.
