/4kJ , iV' 10("' I AN ORDINANCE DECLARING VACATED. ABANDONED AND CLOSED THAT PORTION OF THE STREET OR ALLEY LOCATED ON THE NORTH OR OORTHWEST SIDES OF LOTS NOS. THIRTEEN (13) AND FOURTEEN (14) OF THE W.O. MEINERS FIRST SUBURBAN ADDITION; AND AUTHORIZING THE EXECUTION OF A DEED BY THE MAYOR OF THE CITY OF SAN MARCOS TO CHARLES A. ZUNKER OF ANY INTEREST THE SAID CITY MAY HAVE IN SUCH PORTION OF SAID ALLEY. *********AAAAAAAAA1***** WHEREAS. the City of San Marcos has received, from Charles A. Zunker, a petition requesting the declaration that the portion of the street or alley located on the North or Northwest sides of Lots Nos. Thirteen (13) and Fourteen (14) of the W. O. Meiners First Suburban Addition henceforth be vacated, abandoned and closed; and I WHEREAS, said petition does further request that the City of San Marcos execute a deed without warranty, conveying all in- terest of said city, if any, in such portion of said stree~ or alley to the said Charles A. Zunker; and WHEREAS. the City of San ~rcos, through its agents, has duly determined that such portion of said street or alley has never been constructed upon the ground, has never been used for any public purpose, will not be used for any public purpose in the foreseeable future, and that it, therefore, is to the interest of the public in general and said city in particular that such portion of said street or alley be abandoned, vacated and closed, immediately and permanently; and WHEREAS. the City of San Marcos, through its agents, has duly determined that the said Charles A. Zunker is the sole owner of all property abutting upon or against such portion of said ~t~eet or alley: :1 NOW. THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, as follows: Section 1. That the portion of the street or alley located on the North or Northwest sides of Lots Nos. Thirteen (13) and Fourteen (14) of the W. O. Meiners First Suburban Addition to the City of San ~rcos. a map or plat of said addition being located in Volume 89, page 289, Hays County Deed Records, is hereby de- clared to be and henceforth shall be vacated, abandoned and clos- ed as to any use, right or claim whatsoever of the public in general and the City of San ~rcos, in particular. Section 2. That any interest the City of San Marcos may have in such portion of said street or alley be conveyed immediately by the City of San Marcos to the said Charles A. Zunker for the consideration of $10.00, and other good and valuable consideration, such conveyance to be by deed without warranty executed by the mayor of said city and attested by the secretary thereof.
