<br />of the building is ess than 50% of its value, the Board
<br />of Adjustment may grant a per.lllit for repair after a public
<br />hearing and having due regard for the public welfare, safety,
<br />and the character of the area surrounding the nonconforming
<br />use property, keeping in mind the conservation and preser-
<br />vation of the adjacent property.

<br />SECTION 18
<br />
<br />BOARD OF ADJU STMENT
<br />

<br />
<br />There is hereby crea ted a Board of Adjustment consisting
<br />of five members, each to be appointed for a term of two
<br />years by the Mayor, with the approval of the City Council;
<br />the Board shall elect one of its members to act as Chairman.
<br />Any member may be removed for cause by the appointed
<br />authority upon written charges and after a public hearing.
<br />The appointing authority sha il fiIl vacancies for the un-
<br />expired term of any member whose term may become vacant.
<br />All cases to be heard by the Board of Adjustment will
<br />aiways be heard by a minimum number of four members.

<br />The Board shall adopt rules of procedure and be vested
<br />with all of the powers granted said Board in accordance
<br />with Article 1011g VTCS, as amended, as though that
<br />Article were incorporated herein: however, the Mayor shall
<br />indicate at the time of the appointment which two of
<br />the five members shall hold office for a period of
<br />one year and which three of the members so appointed
<br />shaIl hold office for a two year term. After the initial
<br />appointment, the members appointed and re-appointed shall
<br />hold office for a'Jperiod of two yea,s unless a vacancy
<br />exists as herein provided.

<br />SECTION 19 ENFORCEMENTS AND REMEDIES
<br />
<br />Any violation of this Ordinance or section thereof. is
<br />hereby declared to be a misdemeanor and, upon conviction,
<br />shall be subJect,to a fine of not less than $5.00 nor more
<br />than $200.00 for any violation.
<br />
<br />In case any bulldinq or structure is erected, constructed,
<br />reconstructed, altered, repaired, converted, or maintained
<br />of any building, structure, or land is used in violation
<br />of this Act or of any Ordinance or other regulation made
<br />under the authorities of the municipality, in addition to
<br />other remedies. the City may institute any appropriate
<br />action or proceedings to prevent such unlawful erection,
<br />construction, reconstruction, alteration, repiar, conversion,
<br />maintenance, or use, to refrain, correct, or abate such
<br />violation, to prevent the occupancy of said building,
<br />structure or land, or to prevent any illegal act, conduct,
<br />business, or use in or about such premises.

<br />SECTION 20
<br />
<br />CONFLICTING ORDINANCES.
<br />
<br />It is the intention of the Governing Body that this Ordinance
<br />should supplement existing ordinances, and any ordinance,
<br />word, phrase, clause, sentence, or section thereof in conflict
<br />with this Ordinance shall remain in full force and effect; how-
<br />ever, in the event that this Ordinance shaIl impose a more
<br />restrictive requirement, then this Ordinance shall control.
