<br />-12- <br /> <br />(Jil <br /> <br />SECTION 16 SETBACK <br /> <br />I <br /> <br />1. "R" District - a minimum of 25 feet from the front <br />property line, and, if a corner lot, 25 feet from the <br />curb line of the adjoining street, unless by deed <br />restriction the requirement for set-back is greater, in <br />which case, the greater requirement shall prevail. <br />If the pattern of buildings on the majority of the existing <br />lots has established a set-back line different from the <br />minimum, then that line shall control future construction <br />and all buildings shall conform thereto. No portion <br />of a dwelling unit including carport, covered patio, <br />etc., shall extend beyond the set-back line. Fences <br />and shrubbery from the street to the set-back line <br />shall not exceed three feet in height. No building <br />shall be built closer than five feet to the adjoining <br />property line and/or the rear property line. <br />2. "D" .District - same as "R". <br />3. "M" District - same as "0" <br />4 . ''P--l'' District - same as "R", "D", and "M" in <br />their respective districts. <br />5. "p- 2" District - Dormitories and living quarters shall <br />be set back 20 feet from any street line. Buildings <br />used for instructional use, libraries, museums, student <br />unions, refectories, and other buildings not designed <br />for housing of students shall require no set-back:. <br />6. "C" District - there shall be no set-back restrictions. <br />7. "I" District - there shall be no set-back restrictions. <br /> <br />SECTION 1 7 <br /> <br />NONCONFORMING USES <br /> <br />I <br /> <br />Any use of property existing at the time of the adoption <br />of this Ordinance that does no conform with the regulations <br />prescribed in the preceding sections of this Ordinance shall <br />be deemed a nonconforming use. <br /> <br />The lawful use of the property exsiting at the time of the <br />adoption of this Ordinance, although such use does not <br />conform to the provision hereof. may be continued. If <br />such nonconforming use is discontinued, any further use <br />of such property shall be in conformity with the provisions <br />of this Ordinance. Nonconforming uses may be allowed <br />to continue but shaH not be allowed to expand. Property <br />repairs shall be made after permission has been obtained <br />from the Board of Adjustment, and any abandonment of its <br />use results In loss of the privilege of the nonconforming <br />use. Any structural alterations required to change a building <br />or structure from a nonconforming use to conform with the <br />requirements of the district in which it is located must be <br />accomplished before the building may be lawfully used. <br /> <br />I <br /> <br />If the judgement of the Board of Adjustment, herein provided <br />for, deems it to be reasonable to require alterations, main- <br />tenance of the premises or conditions of operation of a <br />nonconforming use bulldlng, required for the protection of <br />the adjacent property, then such reasonable adjustments may <br />be required. <br /> <br />A nonconforming use permit shall not be extended In the <br />case of partial dlstruction by fire or other causes, including <br />obsolescence, to the extent of 50% or more of the valuEl of <br />
