<br />..- <br /> <br />STATE OF TEXAS 1 <br />COUNty OF HAYS I <br /> <br />I <br /> <br />THIS AGREEMENT executed in duplicate originals, entered into this the <br />21st day of August, A. D., 1963, by and between the City of San Marcos, a <br />Municipal Corporation, located in Hays County, texas, organized and operating <br />under the General Laws of the State of texas, acting by and through its Mayor, <br />hereinafter called "treCity" and E.E. McAdams of Austin, travis County, Texas, <br />an individual person, hereinafter called "the Consultant": <br /> <br />WItNESSETH: In consideration of their mutual covenants contained herein, <br />the pilrties hereto agree as follows: <br /> <br />SECtION 1 The Consultant shall: <br /> <br />(1) Codify the ordinances of the City, including revisions <br />necessary to bring the ordinances up to date or in line with presently <br />accepted practices and applicable State laws. <br /> <br />(2) Furnish the City with'l_a typewritten copy of all ordinances <br />to be included in the Code. The purpose of this copy is to permit <br />City Officials to review the ordinances prior to final typing. <br /> <br />I <br /> <br />(3) Furnish the City with a complete typewritten copy of <br />the Code, ready for the printer, including the index. the ordinances <br />in the Code shall be systematically arranged by the Consultant accord- <br />ing to subjects, alphabetically listed and numbered by articles and <br />sections. <br /> <br />(4) Prepare and furnish the City an inaex for the ordinances <br />to be included in the new Code of Ordinances. <br /> <br />(5) Proceed with the codification work within thirty (30) days <br />after the date of acceptance and approval of this Agreement by the <br />City Council and will complete the work within seven (7) months from <br />such date. <br /> <br />(6) Perform the research in locating the ordinances to be <br />copied and assist with and give advice in the selection of ordinances <br />to be included in the Code. <br /> <br />(7) For thirty (30) days after completion of work, shall stand <br />ready to assist the City in obtaining bids and making arrangements for <br />the printing and binding of the final draft of the Code and its index. <br /> <br />SECtION II The City shall: <br /> <br />I <br /> <br />(1) Make available the services of the City Attorney or some <br />other attorney to pass upon any legal questions which may arise in <br />connection with the codification work. <br /> <br />(2) Furnish the Consultant with one legible copy of each <br />ordinance and its amendment, if any, which has been selectedty <br />the Consultant to be considered for inclusion in the Code. It is <br />understood that certain types of ordinances need not be included in <br />the Code, such as franchises, those covering the issuance of bonds, <br />street paving proceedings, annual tax levies, and similar ordinances. <br />the decision as to non-inclusion being left to the' City Attorney or <br />other attorney designated by the City. <br />
