THE STATE OF TEXAS COUNTY OF HAYS x X 54 LEASE AGREEMENT KNOW ALL ~ŒN BY THESE PRESENTS: That the city of San Marcos, Texas, a municipal corporation under the laws of the State of Texas, acting through authority conferred on its Mayor Pro Tem, Berry R. James , by a resolution duly adopted on May 11, 1981 , hereinafter re- ferred to as "city" and Buda Industries, Inc., acting by and through its Vice-President, Jerry Cox, hereinafter referred to as "Lessee" enter into this lease agreement for the mutual benefit of the parties consisting of the following terms and conditions: I. City does hereby demise and let unto Lessee a portion of that real property owned by City by virtue of an indenture from the United ,States of America dated the 14th day of February, 1966, the 14th day of July, 1969, and the 11th day of May, 1976, to which reference is hereby made and by such reference made a part thereof, and known as the San Marcos Municipal Airport (Airport). The demised premises are described particularly in the attached Exhibits, A & B, which are hereby made part of this lease agreement. II. City hereby grants Lessee permission to use said demised premises for a period of thirty (30) days beginning May 23, 1981, and ending June 21, 1981. III. It is agreed that permission to use the property herein granted to Lessee is for the purpose of conducting an auction of heavy equipment by Miller and Miller Auctioneers of Fort Worth, Texas. Heavy equipment brought to and from the airport will be delivered and hauled off the premises by use of the gravel road leading to the City of San Marcos Municipal Landfill. No portion of any equipment brought onto saiddernised premises pursuant to the terms of this lease shall be extended at any time to a height of more than fifty feet from the ground.
