2. IV. Lessee agrees to pay to City the sum of Two Thousand Five Hundred Dollars ($2,500.00) as rental for said demised premises. Payment shall be made to City prior to May 23, 1981. V. It is agreed that Lessee will comply with all Texas Alcoholic Beverage Commission rules and regulations for any activities conducted upon the demised premises pursuant to this lease agreement. VI. As a condition precedent to the use of the property, Lessee agrees to indemnify and hold harmless City from all damages, claims, losses, demands, suits, judgments, costs and expenses arising from the use of said property as a site for the auction of heavy equip- ment and shall defend any litigation arising in connection with said use, including reasonable attorneys' fees, whenever said damages, claims, losses, demands, suits, judgments, costs or expenses are caused in whole or in part by any negligent act or omission of Lessee, anyone directly or indirectly employed by Lessee or anyone for whose acts Lessee may be liable, regardless of whether said damages, claims, losses, demands, suits, judgments, costs or expenses are caused in part by City. Lessee shall occupy said property at its own risk, and releases City, to the full extent permitted by law, from all claims of every kind resulting in loss of life, personal or bodily injury or property damage. VII. Lessee shall maintain at its own cost and expense and shall file with City a policy of public liability insurance issued by a casualty company duly authorized to do business in the State of Texas in an amount of not less than One Hundred Thousand Dollars ($100,000.00) for bodily injury, personal injury or death to any one person and Three Hundred Thousand Dollars ($300,000.00) for any single occurrence of bodily injury or death and One Hundred Thousand Dollars ($100,000.00) for any single occurrence for injury or destruction of property.
