-4- XI. It is agreed that Lessee shall in no way interfere with normal use of Airport facilities by fixed base aircraft during the auction conducted pursuant to the terms of this lease agreement. Aircraft with hangar space shall have continuous access to and from hanger area. XII. During time of war or national emergency, City shall have the right to lease the landing area, airport or any part thereof to the United States Government for military or naval use, and if such lease is executed, the provisions of this instrument insofar as they are inconsistent with the provisions of the lease to the Government, shall be suspended. This lease shall be subordinate to the provisions of any existing or future agreement between City and the United States, relative to the operation or maintenance of the airport, the execution of which has been or may be required as a condition precedent to the expenditure of Federal funds for the development of the airport. XIII. City agrees to waive its right to object to an assignment or transfer of rights and privileges by Arnold Schaeferkoeter to Lessee for the period of time described in Part II under the terms of the agricultural lease agreement entered into by City and Mr. Schaefer- koeter on January 1, 1977. Lessee shall agree in writing to abide by and accept all the provisions of said lease agreement between City and Mr. Schaeferkoeter. XIV. The City of San Marcos Airport Commission shall approve all facilities and utilities to be installed by Lessee. XV. It is specifically understood and agreed that nothing contained herein shall be construed as a granting or authorizinG the granting of an exclusive right for exercising of an aeronautical activity, nor to conduct any activity which is discriminator~ and Lessee specifically agrees tô operate a non-discriminatory operation.
