Worrell <br />Albert Walker <br /> <br />Visitors; <br /> <br />Mrs. Jerri Veidt and Tom Buckner <br /> <br />The Mayor called the meeting to order at 9 a.m., December 6, 1963. <br />Members of the Counci~ Signed a "Consent to Meeting". <br /> <br />Mayor Taylor stated the purpose of the meeting, as per written <br />notice to Council Members, copy attached. He noted that <br />Mr. Billy J, White was not present; that he had requested an extension <br />from the called meeting December 4, In accordance with his request for <br />a 48-hour extension, the present meeting had been set. The Mayor then <br />read the ;ollowing telegram from Attorney J.P. Gutierrez of San Antonio, <br />a copy of which is attached to these Minutes; <br /> <br />I <br /> <br />"Following wire sent to B,R. Fuller City Manager San Marcos Texas <br />quote This is to advise you that Sgt, Billy James White formerly <br />Sgt, of Police Department your city has retained me to represent <br />him on his unwarranted discharge from his duties by Chief of Police <br />Dial. Copy of charges denied Sgt. White by Chief Dial and not given <br />to him until Wednesday afternoon, Unable to prop~~~~pare case called <br />by appointed time Friday December 6, 1963 in the/Council Meeting <br />for appeal of Sgt. White case. Request proper time be given of City <br />Charter dealing with hireing (sic) of employees and the rights of <br />appeal when dismissed. Should request be denied will take such legal <br />steps as will be necessary to be favored with the above requests <br />and thanking you remain J.P. Gutierrez Attorney-at-Law 16-20 Tower <br />Life Building San Antonio Texas" <br /> <br />Mayor Taylor asked the pleasure of the Council on the att~rney's request, <br /> <br />I <br /> <br />Alderman Ruiz expressed the opinion that the hearing should be held, <br />since, should Attorney Gutierrez appear before the Council, there would <br />be nothing he could do, it not being a trial. The Mayor replied that <br />the Council had to hear Mr. White's rebuttal to the charges of dismissal, <br />and Mr. White was not present at his requested hearing. City Attorney <br />Walker said the Council could presume that Mr. White's attorney was <br />speaking for him, in the telegraphed request, for a further extension. <br />The Mayor stated he thought a time limit'~should be set for a grievance <br />hearing in the City's Personnel Policy, in order that such a matter <br />should not "drag on". <br /> <br />The City Attorney said Mr. White had been given ample time, "but you <br />do not want to foreclose on him", <br /> <br />Alderman Ruiz moved that the Billy J.
