<br />The Mayor called the meeting to order at 7130 p.m.

<br />The.Minutes of the previous meetings were unanimously approved as
<br />presented, on motion of Alderman Stokes, and second of Alderman Pool.
<br />
<br />AttorneyJ'.P. Gutierrez appeared before the Council with his client,
<br />Mr. Billy J. White. He presented a motion for continuance on the
<br />scheduled hearing to Mayor Taylor. The Mayor read aloud the document,
<br />attached as a part of these Minutes. Members of the Council discussed
<br />the matter, and directed some questions to Attorney Gutierrez. The
<br />Mayor asked the City Attorney for a recommendation. City Attorney Walker
<br />stated the Council had full power to approve or disapprove the dismissal
<br />of Police Sergeant Billy J. White at this scheduled hearing. In a court
<br />of law, the City Attorney stated, the first plea for continuance is usually
<br />granted, and addedl "I believe I would recommend a continuance be granted".

<br />Alderman Stokes enquired of Mr. White's counsel whether he understood that
<br />the December 9 meeting was the third hearing set, and whether he knew that
<br />the City of San Marcos does no~ have a charter, nor civil service,
<br />Mr. Gutierrez indicated he had learned those facts that day.
<br />
<br />Alderman Moore asked Mr. Gutierrez if ten days would be sufficient time
<br />for him to prepare his client's appeal, Mr. Gutierrez agreed to a
<br />ten-day delay, Alderman Moore moved that the hearing be re-set for
<br />7130 p.m., Thursday, December 19. Alderman Pool seconded the motion,
<br />and on roll call, the following vote was recorded;

<br />Whereupon, the Mayor declared the motion carried, and the hearing
<br />re-set for December 19,
<br />
<br />Mr. Gutierrez, Mr. White and City Attorney Walker left the meeting
<br />after postponement of the hearing.
