i "j' ;;; SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, DECEMBER 20,1963 Present I Mayor Frank Taylor I Aldermen; Wm. L. Moore, M.D. William C. Pool Ruben Ruiz H. Garland Stokes City Manager City Secretary B.R. Fuller Dorothy O. Worrell The. Mayor called the meeting to order at 5;30 p.m. Members of the Council signed "Consent to Meeting", attached as a part of these Minutes. The Mayor stated that the question of the hearing on dismissal of Billy James White from the San Marcos Police Department had reached a point where he felt it was of the utmost importance that it be settled. He recommended that Mr. White's dismissal be sustained, or that he be reinstated, and that all the material pertaining to the case be gathered and turned over to the Grand Jury. Councilmen expressed general agreement with the Mayor's recommendation. I Alderman Stokes moved that in the best interests of the City of San Marcos, Chief Dial's dismissal of Billy James White be sustained, as of November 30, 1963; that a press release be issued to all news media; and that Mr. White be furnished with a copy immediately. Alderman Pool seconded the motion, which passed unanimously. Alderman Stokes moved that the following news release be issued: "The City Council of the City of San Marcos has considered carefully the matter of the dismissal of Mr. Billy J. White and sustains the action of the Chief of Police in the dismissal. Further, the Council has caused an independent investigation to be made by the City Attorney, in whom the Council has complete confidence. The Council is satisfied with the investigation. However, since the Council is a policy-making body, it is the belief of the Council that it has gone as far as it should in the matter. The Council feels that it should indicate to the citizens of San Marcos that it has no wish to suppress any of the charges or countercharges. Therefore, the Council is directing that all letters, findings and any other pertinent information be placed in an envelope and delivered to the Foreman of the Hays County Grand Jury for such action as he considers proper." Alderman Ruiz seconded the motion, which passed unanimously. I The Mayor said the Council would probably have to convene on the same matter one more time, to check all the data. to be turned over to the Grand Jury. After discussion of the matter, it was the concensus that it would not be necessary for the entire Council to check the data. Alderman Stokes moved that the Mayor, the City Manager and the City Secretary check the material and forward it to the Grand Jury.
