L. Moore, M.D. <br />William C. Pool <br />Ruben Ruiz <br />H. Garland Stokes <br /> <br />City Manager <br />City Secretary <br /> <br />B.R. Fuller <br />Dorothy O. Worrell <br /> <br />The. Mayor called the meeting to order at 5;30 p.m. Members of the <br />Council signed "Consent to Meeting", attached as a part of these Minutes. <br /> <br />The Mayor stated that the question of the hearing on dismissal of <br />Billy James White from the San Marcos Police Department had reached <br />a point where he felt it was of the utmost importance that it be <br />settled. He recommended that Mr. White's dismissal be sustained, <br />or that he be reinstated, and that all the material pertaining to the <br />case be gathered and turned over to the Grand Jury. <br /> <br />Councilmen expressed general agreement with the Mayor's recommendation. <br /> <br />I <br /> <br />Alderman Stokes moved that in the best interests of the City of <br />San Marcos, Chief Dial's dismissal of Billy James White be sustained, <br />as of November 30, 1963; that a press release be issued to all news <br />media; and that Mr. White be furnished with a copy immediately. <br />Alderman Pool seconded the motion, which passed unanimously. <br /> <br />Alderman Stokes moved that the following news release be issued: <br /> <br />"The City Council of the City of San Marcos has considered carefully <br />the matter of the dismissal of Mr. Billy J. White and sustains the <br />action of the Chief of Police in the dismissal. Further, the Council <br />has caused an independent investigation to be made by the City Attorney, <br />in whom the Council has complete confidence. The Council is satisfied <br />with the investigation. However, since the Council is a policy-making <br />body, it is the belief of the Council that it has gone as far as it <br />should in the matter. The Council feels that it should indicate to the <br />citizens of San Marcos that it has no wish to suppress any of the <br />charges or countercharges. Therefore, the Council is directing that <br />all letters, findings and any other pertinent information be placed <br />in an envelope and delivered to the Foreman of the Hays County Grand <br />Jury for such action as he considers proper." <br /> <br />Alderman Ruiz seconded the motion, which passed unanimously. <br /> <br />I <br /> <br />The Mayor said the Council would probably have to convene on the <br />same matter one more time, to check all the data. to be turned over <br />to the Grand Jury. After discussion of the matter, it was the <br />concensus that it would not be necessary for the entire Council to <br />check the data. Alderman Stokes moved that the Mayor, the City <br />Manager and the City Secretary check the material and forward it to <br />the Grand Jury.
