-3- E. For the additional service described in E of Article II payment shall be made in the amount of seven hundred seventy four dollars and twenty cents ($774.20). ARTICLE IV. Methog of p~yment Payment for services performed by Surveyor pursuant to this Agreement shall be made by City upon presentation of a statement by Surveyor for such services. Such statement shall list all services performed to date, shall identify each service as a "Basic Service" or an "Additional Service" and shall list separately the amount due for each item identified as an "Additional Service. " ARTICLE V. Term of Agreement All services to be performed under the terms of this Agree- ment shall be performed within six (6) months from the date of execution. ARTICLE VI. Agreement Not Assignable This Agreement shall not be assignable in whole or in part without the consent of City. Surveyor binds himself, his successors, executors, administrators and assigns to City and to successors or assigns of City in respect to all covenants of this Agreement and City binds itself, its successors and assigns to Surveyor in respect to all covenants of this Agreement. ARTICLE VII. Termination of Agreement In connection with services to be performed pursuant to this Agreement, it is agreed that City or Surveyor may cancel or terminate this agreement immediately upon written notice to the other party. Upon receipt of any such notice, Surveyor shall, unless the notice directs othenvise, immediately discontinue all services in connec- tion with the performance of this Agreement. As soon as practicable after receipt of notice of termination, Surveyor shall submit a statement, showing in detail the services performed under this agreement to the date of termination. The City shall then pay Surveyor promptly that portion of the prescribed fee which the services actually performed under this agreement bear to the total services called for under this agreement.
