<br />regular meeting, march 9, 1964, page two <br /> <br />Alderman Stokes introduced an Ordinance annexing right-of-way on State <br />Highway 80 (being the second ~ mile to be annexed) and moved its adoption. <br />Alderman Moore seconded the motion and on roll call the following vote was <br />recorded: <br /> <br />AYE: Moore, Pool, Ruiz, Stokes <br />NAY: None <br /> <br />Whereupon, the Mayor declared the motion carried, and the property annexed. <br /> <br />Alderman Moore introduced an Ordinance annexing property in the Westover <br />Addition, identified as all of Block 49 of the Westover Addition ill <br />(Lots 353-356 both inclusive) and a portion of unplatted land contiguous <br />with the City Limits and owned by S.R. & Bert Beecroft. (A plat is attched <br />and made a part hereof). Alderman Moore moved the adoption of the Ordinance; <br />Alderman Stokes seconded the motion; and on roll call, the following vote <br />wa s recorded: <br /> <br />AYE: Moore, Popl, Ruiz, Stokes <br />NAY.: None <br /> <br />Whereupon, the Mayor declared the motion carried and the property annexed. <br /> <br />In c!lnsideration of "City Manager Items", the Tax Assessor-Collector <br />requested the following case be brought before the Council for decision: <br /> <br />"Lots 3,9,11, B~ock 5, Cedar Plateau, are owned by H.B. Rainwater, <br />Mrs. Pearly Averyt and Mrs. Frank Rainwa~er. The City's tax roll <br />carries these lots in the name, of Averyt-Rainwater; the County <br />shows Mrs. Frank Rainwater. The City's tax notices have been <br />returned unclaimed. The property was annexed in 1957 and taxes <br />are due since 1958. The owners claim they were not notified and <br />were unaware of any taxes due. They have requested that the City <br />adjust the taxes, (penalty and interest)." <br /> <br />The City Manager stated that the request was not consistent with estab- <br />. lished pOlicy and should be denied. By common consent, the Council <br />agreed to maintain the established. policy and refuse the request for <br />adjustment of taxes owed. <br /> <br />.' <br /> <br />As previously requested, the City Manager presented copies of an Ordinance <br />prepared by the City Attorney, prohibiting the operation of billiard <br />tables in San Marcos for profit. Alderman Stokes moved that the consid- <br />eration of the Ordinance be tabled. Alderman Moore seconded the motion, <br />and subsequently withdrew his second. The Mayor enquired whether the <br />Ordinance should be read aloud, and, receiving an affirmative answer, <br />read the Ordinance. A discussion of the merits of the ordinance followed. <br />Alderman Moore moved that the Ordinance prohibiting billiard tables in <br />San Marcos not be passed, and that the City Attorney be instructed to <br />draw up an ordinance regulating and controlling the operation of billiard <br />tables for profit in San MarcoS. Alderman Pool seconded the motion. <br />Further discussion on the matter ensued. Alderman Ruiz recommended that <br />in the event that a building were erected or renovated for the use of <br />billiard tables at some future time, the operator be required to conform <br />strictly to the Building Code. The question being called for, the <br />following vote was recorded: <br /> <br />AYE: Moore, Pool <br />NAY: Ruiz, Stokes <br /> <br />i <br />The Mayor,being required to cast the deciding vote, voted "Aye", and IlL <br />declared the motion carried. He instructed the City Secretary to request <br />the City Attorney t@ draw up an ordinance regulating and controlling <br />the. operation of b!lliargc tables for profit in San Marcos. <br /> <br />I <br /> <br />fjOH <br />
