<br />The City Manager provided the Council with a status report on the
<br />Local Public Agency, prepared at the request of the Mayor.
<br />
<br />The Mayor introduced Item 3 of Addendum No. 1 of City Manager Itemsl
<br />Cause No. 8l40, JOHN C.MORALES vs KENN.ErHE. SUTTON, Judge of Corporation
<br />Court, San Marcos, Texas, and WAYMAN A. DIAL, Police Department of the
<br />City of San Marcos, Texas, filed in District Court, 155th Judicial District.
<br />Item 3 concluded with the following recommendation from the City Manager:
<br />
<br />"It is the opinion of-the City Manager that the defendants in this
<br />suit were acting in an official capacity and the City should provide I
<br />competent counsel to protect and defend the said Judge Sutton and
<br />Chief Dial as agents of the City unless and until the Council has
<br />been legally advised by its own counsel, the actions of the two
<br />defendants were actually 'malfeasance' as alleged in the Plaintiff's
<br />original petition, in Which case the City would not be legally
<br />responsible."

<br />~lderman Pool moved that the Council prOVide legal counsel for City
<br />employees in CaUSe No. 8l40, subject to legal ruling; and further, that
<br />the Council employ the same firm (Clark, Thomas, Harris, Denius & Winters)
<br />already employed to defend the City in Cause No.' 8138. Alderman Ruiz
<br />seconded the motion, which carried unanimously.
<br />
<br />The Council agreed by common consent that at least two firemen and an
<br />assistant fire marshal be sent to the annual Texas Firemen's Training
<br />SChool at Texas A & M UniverSity, July 19-24, 1964.
<br />
<br />Alderman Whittenber~ suggested the possibility of placing two more
<br />floodlights in the parking area of Memorial Park be investigated.
<br />
<br />Don Uzzell appeared before the Council to complain of parking violations,
<br />and to votce the opinion that stricter enforcement needs to be exercised.
<br />
<br />The Mayor said he had received a request from Dr. Greer to build a motel
<br />in Rio Vista. He stated the petition for a building permit had been I
<br />refused before, since the property is within the boundaries of the
<br />proposed General Neighborhood Renewal Program, and no building permits
<br />may be issued. Alderman Whittenberg said that as h~ understood it,
<br />"we have a mandate from the people on that GNRP, and we have no altern-
<br />ative... - - .

<br />The City Mjnager presented plans for "Blanco Gardens Subdivision" for
<br />the Mayor's signature.
<br />
<br />Jesse Ivey came before the Council. He stated that an employee owns
<br />land on Water Street and would like to know the possible purchase date
<br />of land in the proposed 'River Development of GNRP. The Mayor told
<br />Mr. rvey that no definite date could be given. Mr. rvey's second request
<br />was for the date when he could expect sewer conneotion at his home at
<br />l09 West Hillcrest. He complained that he had borrowed money and built
<br />a bathroom with the expectation that he would have sewer service by
<br />February, 1964. The City Manager said a sewer line could be run if the
<br />Council wished to give it priority over other scheduled work. The Mayor
<br />assured Mr. Ivey that the matter would be investigated.
<br />
<br />The meeting adjourned at 10100 p.m., to reconvene at 7130 p.m., Monday,
<br />May l8, 1964, on motion of Alderman Pool, and J!Y_J1pmmon 9~~nt.
