Fuller <br />City Manager <br />City Hall <br />San Marcos, Texas <br /> <br />Re: Restrictive covenant <br />pertaining to "commerciall1 <br />uses of property <br /> <br />Dear Mr, Fuller: <br /> <br />Many out-of-s"t;ate CaS{3S dealing VJith the specific question <br />as to whether or not an apartment house is a commercial structure <br />or ti18 building of ap8ptment .houses 18 a commercial lJenture <br />have come to the conclusion t;:hat such 3 venture of SUCll struc- <br />turG is not commercial in natuI'e. There is, however, a Texas <br />case styled Green Avenue ApaI'tments v. Chambers, 239 S.W.2d <br />675, which is a 1951 Court of Civil Appeals opinion that states <br />trlat an apartment house violated the restrictive covenant which <br />read as :follows: <br /> <br />"No y'etail or wholesale shop or sto1'e shall be <br />epected or any business or industry ~ 0:(> any <br />obnoxious or offensive trade shall be carried on <br />upon said premises or anything to be done thereon <br />which may be or become an annoyance or nuisance <br />to the neighborhood and, especially, no malt, <br />1/iDOUS-, Or' spiritous liquors of 8n;y natu2e or <br />other intoxicating liquors of any nature whatso- <br />ever shall be bartered or sold upon any lot," <br /> <br />Additionally, the restr:Pctlon said: <br /> <br />"Any lot or lots in said addition, \olhen seld, <br />now and hereafter, shall be used for residential <br />pUI'poses only, and only one dwelling house with <br />.the necessary outhouses tIJerefoj." shall be con- <br />structed and maintained upon any such lot of <br />land." <br />
