Every <br />permit is~ued und~r the provisions of <br />Section II of this Ordinance, shall say <br />in substabce~ that such permit is issued <br />in consideration of the Administrative <br />Charge paid therefor and the right of the <br />City of San Marcos to revoke or suspend <br />such permit subject to the provisions of <br />this Ordinance. The payment by any person <br />of the License Tax required herein, shall <br />not rei ieve such person of any ad valorem <br />tax or any other legal tax now required or <br />that may be hereafter required under the <br />terms and conditions of this Ordinance or <br />the laws of the State of Texas. The Admin- <br />istrative Charge made under the provisions <br />of this Ordinance shall be for the whole or <br />any fractional part of a calendar year and <br />shall not be pro-ratable. In no case shall <br />any Permittee be entitled to rebate or re- <br />turn of any fees paid under the terms, con- <br />ditions and provisions of this Ordinance. <br /> <br />SUSPENSION OF PERMIT: Permits issued under <br />the provisions of this Ordinance may be re- <br />~oked or suspended by the Chief of Police <br />whenever it has been brought to his atten- <br />tion that the licensee or any agent, servant <br />or employee of such licensee has violated any <br />provision of this Ordinance; provided, however, <br />any permittee shall have the right to appeal <br />such decision to suspend or revoke to the City <br />Counci I. Such permittee shal I be entitled to <br />a hearing before the City Counci I at any reg- <br />ular meeting after ten (10) days written not- <br />ice has been given to the City Secretary of <br />such appeal. Upon receipt of notice to ap- <br />peal, the City Secretary shal I place the same <br />upon the agenda of the next regular meeting <br />of the Counci I for consideration. <br /> <br />INSPECTIONS: The San Marcos Police Department, <br />as a condition to the issuance of such permit <br />for the operation of bi I liard tables within <br />the City Limits of San Marcos, Texas, shal I have <br />the right, at any time, to go upon the premises <br />of such establishment for the purposes of en- <br />forcement of the provisions herein stated as <br />wel I as other city ordinances. The City Sani- <br />tar i an, Bu i I ding I nspector and other author i zed <br />City personnel shal I have the right to make per- <br />iodic inspections of the premises, and it shal I <br />be their duty to determine that such premises <br />comply with the bui Iding, health, plumbing, san- <br />itary and other applicable codes and ordinances <br />of the City of San Marcos. <br />
