<br />AN ORDINIINCE PROMOTING THE HEALTH AND WELFARE OF THE
<br />CITIZENS OF SAN MARCOS. TEXAS, BY MAKING IT UNLAWFUL TO
<br />THROW. DROP, PLACE OR DEPOSIT UPON A STREET, ALLEY. SIDE-
<br />WALK OR OTHER PUBLIC PLACE WITHIN SAID CITY. RUBBISH. TRASH.
<br />GARBAGE. ASHES. JUNK OR OTHER IMPURE. UNSIGHTLY. UNWHOLE-
<br />SOME OR UNSANITARY MATTER OF ANY KIND; PROVIDING FOR A
<br />PENIILTY FOR ANY SUCH VIOLATION; AND CONCLUDING WITH PARTIAL
<br />INVALIDITY. REPEAL OF CONFLICTING ORDINANCES AND EFFECTIVE
<br />DATE PROVISIONS.

<br />WHEREAS, it is deemed by the City Council of the City of San
<br />Marcos, Texas, that the health and welfare of the public in general
<br />and that of the citizens of San Marcos in particular is or will be
<br />endangered by the throwing, placing, dropping, or depositing upon a
<br />street, alley, sidewalk or other public place within said city of
<br />rubbish, trash, garbage, ashes, junk or other impure, unsightly,
<br />unwholesome or unsanitary matter of any kind:

<br />NOW, THEREFORE. be it ordained by the City Council of the City
<br />of San Marcos, Texas, as follows:

<br />SECTION 1. It shall be unlawful for any person, firm or cot-
<br />poration to throw, place, drop Ot deposit upon a street, alley, side-
<br />walk or other public place within said city, rubbish, ttash, garbage,
<br />ashes, junk or other impure, unsightly, unwholesome or unsanitary mat-
<br />ter of any kind.

<br />SECTION 2. Any person, firm or individual who shall violate any
<br />ptovision of this ordinance shall be guilty of a misdemeanor, and,
<br />upon conviction, shall be fined in any sum not exceeding Two Hundred
<br />($200.00) Dollars.
<br />
<br />SECTION 3. In case a violation of any ptovision of this ordi-
<br />nance be by a corporation, the president, vice-president, secretary,
<br />treasurer, manager, agent or employee of such corporation also shall
<br />be severally liable for the penalties herein provided.
<br />
<br />SECTION 4. If any part of this ordinance is, or should be held,
<br />invalid for any reason, then that fact shall not invalidate the en-
<br />tite ordinance, but the balance of this ordinance shall remain in
<br />full force and effect.

<br />SECTION 5. All other ordinances or parts of ordinances in con-
<br />flict with this otdinance are hereby repealed.
<br />
<br />SECTION 6. This ordinance shall be in full force and effect upon
<br />its passage and legal publication.
