Don Brod, owner of Aquatic Sports Co., and spokesman for local
scuba divers, came before the Counci I with a request. He ex-
plained that HB 69, a water safety bi I I, had been passed by the
State Legislature and signed by the Governor. Section 15 pro-
vides a $200 fine for any swimmer who comes within 200 yards of
a boat. Section 19 provides that a City may designate certain
areas of publ ic water for use of scuba divers. Mr. Brod made a
formal request to the City Counci 1 that such an area be desig-
nated in Spring Lake of the San Marcos River. Mr. Brod support-
ed his request by quoting figures on the number of scuba divers
who visit San Marcos for the express purpose of swimming in the
clear sp~ing waters of the upper reaches of the River. Others
appearing on behalf of the scuba divers were Gerald Derryberry,
President of the University of Texas Diving Club, Leonard Marsh,
president of a diving club in San Antonio, and Jack Menns of the
Austin Underwater Society. Gene Phi I lips, employee of Aquarena,
stated that they had no objection to skin diving, but were deeply
concerned over the possibi lity of a swimmer's getting hurt by a
propel IeI' of one of the glass-bottomed boats. He explained the
various problems connected with the type of water safety Aquarena
demands. Counci Imen expressed interest in working out a solution
agre~able to all.parties conce~ned. Alderman Froh moved that a
meeting of the CIty Manager, CIty Attorney, representatives of
the diving clubs and Aquarena be held to work out a satisfactory
solution, with the probable result of an ordinance being prepared
