<br />AN ORDINANCE DECLARING VACATED, ABANDONED AND
<br />CLOSED CERTAIN PORTIONS OF CENTER STREET,
<br />BLANCO STREET, SOUTH STREET AND ELM STREET,
<br />A PART OF THE F. P. DANNELLY ADDITION TO THE
<br />CITY OF SAN MARCOS; AND AUTHORIZING THE
<br />EXECUTION OF A DEED BY THE MAYOR OF THE CITY
<br />OF SAN MARCOS TO JOHN J. STOKES OF ANY INTEREST
<br />THE CITY OF SAN MARCOS MAY HAVE IN SUCH PORTIONS
<br />OF SAID STREETS.

<br />WHEREAS, the City of San Marcos ~as received, from the San
<br />~arcos Independent School District and John J. Stokes, a petition
<br />requesting the declaration by the City of San Marcos that the here-
<br />inafter described portions of Center Street, Blanco Street, South
<br />Street and Elm Street, a part of the F. P. Dannelly Addition to the
<br />City of San Marcos, henceforth be vacated, abandoned and closed; and,
<br />
<br />WHEREAS, said petition does further request that 'the City of
<br />San Marcos execute a deed without warranty, conveying all interest
<br />of said city, if any, in such hereinafter described portions of said
<br />streets to the said John J. Stokes; and,
<br />

<br />WHEREAS, the City of San Marcos, through its agents,has duly
<br />determined that such portions of said streets have never been used for
<br />any public purpose, will not be used for any public purpose in the
<br />foreseeable future, and that it, therefore, is to the interest of the
<br />public in general and said city in particular that such portions of
<br />said streets be abandoned, vacated and closed, immediately and perma-
<br />nently; and,
<br />
<br />WHEREAS, the City of San Marcos, through its agents, has duly
<br />determined that the said San Marcos Independent School District and
<br />John J. Stokes are the sole owners of all property abutting upon or
<br />against such portions of said streets:

<br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
<br />OF SAN MARCOS, TEXAS, as follows:

<br />Section 1. That the hereinafter described portions of Center
<br />Street, Blanco Street, South Street and Elm Street, a part of the
<br />F. P;. Dannelly Addition to the City of San Marcos, are hereby declared
<br />to be and henceforth shall be vacated, abandoned and closed as to any
<br />use, right or claim whatsoever of the public in general and the City
<br />of San Marcos in particular. The portions of said streets so vacated,
<br />abandoned and closed are as follows: (1) That portion of Center Street,
<br />as shown on the map of the F. P. Dannelly Additinn, the map of said
<br />addition being of record in Volume "W", page 405, Hays County Deed
<br />Records, as is bounded on its Northeast side by Lots Nos. Six (6) and
<br />Seven (7) in Block No. Two (2) of the said Dannelly Addition; on its
<br />Southeast side by El~ Street; on its Southwest side by Lots Nos. 12
<br />and 1 of Block No. 5 of said Dannelly Addition; and on its Northwest
<br />side by Cedar Street. (2) That portion of Blanco Street, as shown
<br />on said map of the Dannelly Additinn, as is bounded on its Southwest
<br />side by Lot I in Block 1 of said Dannelly Addition, by Elm Street
<br />and by Lots Nos. 12 and 1 in Block No.2 of said Dannelly Addition;
<br />on its Northwest side by a line running N. 450 00' E. from the most
<br />Northern corner of Lot No.1 in Block No. 2 of said Dannelly Addition
<br />for 10 varas to a point in the Southwest line of Perkins Street; on
<br />its Northeast side by said Southwest line of Perkins Street; and on its
<br />Southeast side by a line running N. 450 00' E. from the most Eastern
<br />corner of Lot I in Block No. 1 of said Dannelly Additinn for 10
