<br />62 <br /> <br />ORDINANCE 1981-41 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING SECTIONS 2-27, 2-28 AND 2-29 <br />OF THE CODE OF ORDINANCES, CITY OF SAN MARCOS, TEXAS, <br />BY SPECIFYING WHAT CONSTITUTES THE UNCLASSIFIED AND <br />CLASSIFIED POSITIONS OF EMPLOYMENT IN SAID CITY <br />SERVICE; BY SPECIFYING THE RESPONSIBILITIES OF THE <br />PERSONNEL APPEALS BOARD; BY SPECIFYING PERSONNEL <br />APPEALS PROCEDURE AND DECLARING AN EFFECTIVE DATE. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />SECTION 1. That section 2-27 of the Code of Ordinances, City of San <br />Marcos, Texas, is hereby amended to read as follows: <br /> <br />Sec. 2-27. Division of Employment <br /> <br />A. All City positions (excluding Fire and Police) are divided <br />into the unclassified and classified services. Unclassified <br />employees include: <br /> <br />1. The City Attorney and all deputies or assistant City <br />Attorneys; <br />2. The City Secretary and all deputies or assistants; <br />3. The City Manager and all deputies or assistant City <br />Managers; <br />4. Temporary employees (those persons who are employed for <br />up to 6 consecutive calendar months); <br />5. Members of all boards, commissions, and committees <br />appointed by the Mayor, or by the Mayor and City Council, <br />or by the City Manager, who serve with or without <br />compensation; <br />6. Employees classified by job title and classification in <br />salary grades E -1 thtoughE-13; and <br />7. Employees hired through federal grant funding. <br /> <br />B. Classfied employees include all positions not listed above, <br />either now existing or later created in compliance with the <br />personnel policies or this manual. <br /> <br />SECTION 2. That section 2-28 of the Code of Ordinances, City of San <br />Marcos, Texas, is hereby amended to read as follows: <br /> <br />Sec. 2-28. The Personnel Appeals Board <br /> <br />A. Responsibilities shall include: <br /> <br />1. hearing appeals of all City employees, except members <br />of the Executive Staff and probationary employees, against <br />disciplinary suspension, discharge, demotion, or removal <br />from permanent status according to the personnel policies <br />of the City. <br />2. making decisions on appeals made by City employees except <br />Executive Staff and probationary employees on such <br />matters as disciplinary suspension, discharge, demotion <br />or removal from permanent status according to the City's <br />personnel policies. The decision of the Board will be <br />final and no appeals will be entertained. <br />3. hearing complaints of employees except members of the <br />Executive Staff and probationary employees and making <br />
