<br />recommendations for solutions and/or findings to the <br />Personnel Representative for his consideration (if the <br />grievance procedure has been fully satisfied). <br /> <br />4. investigating and reporting on personnel administration <br />matters upon request by the City Manager. <br /> <br />5. adopting a set of administering procedures in regard <br />to the ordinance establishing the Personnel Appeals <br />Board. <br /> <br />B. Meetings of the Personnel Appeals Board--The Personnel <br />Appeals Board shall meet as necessary to conduct business. <br />Two members shall constitute a quorum. Meetings shall be <br />posted in compliance with Article 6252-17, Texas Revised <br />Civil Statutes. <br /> <br />C. Members and Representation-- The Board will be comprised <br />of three members: one from the citizen-employee group, <br />one from the citizen-employer group and one from the citizen- <br />professional group. These persons are appointed by the City <br />Manager with the consent of the City Council. Each member <br />shall be at least 25 years of age and have been a resident <br />of San Marcos for at least two continuous years before <br />appointment. The members may not hold salaried public office <br />or compensated appointment nor shall they hold appointments <br />to any other City board, commission or committee. <br /> <br />The members shall not be financially interested in any con- <br />tract with the City. There is no compensation involved in <br />serving on the Board. For further information, see the separate <br />manual in the Persònnel Appeals Board operating policies <br />and procedures. This manual will be located in the Personnel <br />Department. <br /> <br />D. Term-- Board members shall serve for a period of three (3) years, <br />or until a successor is appointed, confirmed or qualified. Any <br />vacancies in said board caused by death, resignation or other <br />wise shall be filled by appointment and shall be for the unexpired <br />term. <br /> <br />SECTION 3. That section 2-29 of the Code of Ordinances, City of San Marcos, <br />Texas, is hereby amended to read as follows: <br /> <br />Sec. 2-29. Personnel Appeals Procedure <br /> <br />A. After satisfying all the steps in the grievance procedure, <br />the employee shall submit his appeal in writing within 10 <br />days of final decision of the City Manager to the Personnel <br />Appeals Board via the Personnel Represenative. <br /> <br />B. The appeal is received and a hearing date is set by the <br />Board. The Board will recess into an executive session to <br />conduct the hearing if the employee so requests. <br /> <br />C. The employee may be represented by counsel if he chooses. <br />The City Attorney represents the City. The employee shall <br />notify the Board if there will be any witnesses and if the <br />employee has chosen to use an attorney. <br />
