regu I ar meet i ng, september 13, , 965

:;J,

page three

I

said.he understood that the Counci I t~ok a proper
view, but ."offtherecord, I was worried that pres-
sure had been put upon the Council t? prohibit
swimmers f~om the River". Mr, Brodsaid: ~Section
19 of HB69 does give cities the ,pow~r to de$ignate
areas for certain uses". After more discussion,
Mayor Serur quoted from the minutes of the June 14th
meetirig. Dr. Pool said he had never read HB69; that
he would like to see a copy. Mr. Brad said he under-
stood that "Aquarena got that bill passed..." Re said
he had tried to contact Aquarena, as the Counci I had
suggested; that Don Russe [I and Gene Phi Iii ps had
told him they were planning to put more boats on the
River, and they didn't see how they could 'gettogeth-
er' with the scuba divers. The Mayor suggested again
that they should "do first things first", and get a
written legal opinion. Alderman Whitte.nberg.sa.id he
was as interested as Mr. Brad in hav i ng . a II the peop Ie
come to San Marcos; that he felt it was regrettable
when one business seems to interfere .withanother. He
offered a possible solut.ion that would not cost a great
deal of money: take a crane into the slough and dig a
hole for the scuba divers. ~r. Brad said they needed
clear water, and that a "ho Ie!' would :not. serve the i l'
purpose - that they needed a "large body of water" -
that a person would have to appreciate what it means
to swim in natural surroundings. Alderman Whittenberg
asked Mr. Brad if he were interested in a deep hole
for scuba diving, or if he were just interested in the
area used by the glass-bottomed boats. Alderman Froh
brought out the point that Mr. Rogers had spent a great
de~1 ~f money "mowing" the lake and beautifying it for
tourists. Dr. Pool asked for a clearer definition of
"the lower end of the lake", which scuba divers want
the City to set aside as a restricted area for swim-
mers and divers and fishermen. Mr. Brad said it was
about 200 yards from the headwaters to the "line" they
suggested for their area, and about 200 yards on downstream
to the dam. Dr. Pool assured the scuba divers that each
group had a side, and he sympathized with both. interests.
The Mayor thanked the ~elegation for coming, and express-
ed the hope that the problem could be worked out to the
satisfaction of both groups.

I

The Mayor introduced a petition from Mr. and Mrs. Jack
Clark, requesting annexation of Lot 12 of. Block I, facing
on Franklin Drive, Oak Heights Addition. The accompanying
plat was examined for el igibi I ity for annexation. Alder-
man POol moved that the petition be formally received.
Alderman Damon seconded the motion and on 1'01 I cal I, the
following vote was recorded:

I

AYE:
NAY:

Damon, Froh, Pool, Tuttle, Whittenberg
None

The Mayor declared the motion carried.

The Mayor introduced a petition from J.B. Roberts, request-
Ing annexation of certain property in Forest Hi I Is Addition,
"at such time in the future as said strip of land shall be
contiguous and adjacent to the City Limits".
