<br />RES 0 L UTI 0 N <br /> <br />I <br /> <br />A RESOLUTION AUTHORIZING THE EXECUTION BY THE MAYOR OF <br />THE CITY OF SAN MARCOS AND ATTESTATION BY THE CITY <br />SECRETARY OF THE CITY OF SAN MARCOS OF AN INDENTURE BY <br />AND BETWEEN THE UNITED STATES OF AMERICA AND THE CITY <br />OF SAN MARCOS IN WHICH THE UNITED STATES OF AMERICA <br />CONVEYS TO THE CITY OF SAN MARCOS THE REAL PROPERTY <br />KNOWN AS THE nAIRPORT LANDn, TOGETHER WITH CERTAIN <br />IMPROVEMENTS AND EASEMENTS AND USE RIGHTS IN CONNECT- <br />ION WITH SAID REAL PROPERTY, AND THE CITY OF SAN MARCOS <br />COVENANTS TO ABIDE BY THE RESTRICTIONS AND CONDITIONS <br />GOVERNING THE USE OF SAID HAIRPORT LANDH, ALL AS SET <br />OUT IN SAID INDENTURE. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS: <br /> <br />I <br /> <br />That the Mayor of the City of San Marcos, Texas is author- <br />ized to execute and the Secretary of the City of San Marcos <br />is authorized to attest an indenture by and between the <br />United States of America and the City of San Marcos, in <br />which the United States of America conveys to the City of <br />San Marcos that real property situated in the County of <br />Caldwell, State of Texas, being a part of the former Camp <br />Gary and known as the nAirport Landn, boAsisting of 1303.55 <br />acres, more or less, in the Wi II iam Pettus Two League Grant, <br />described by metes and bounds in said indenture, said indent- <br />ure further conveying to the City of San Marcos certain air- <br />port improvements including landing facilities, marking and <br />lighting facilities and buildings, as well as easements and <br />use rights, all as set forth in said indenture bearing even <br />date with this resolution, such instrument being hereby re- <br />ferred to and made a part hereof for al I pertinent, legal and <br />descriptive purposes. Said indenture further sets out certain <br />restrictions and conditions governing the use of said HAirport <br />Landn by the City of San Marcos, which restrictions and Con- <br />ditions the City of San Marcos hereby agrees to comply with <br />in every respect within its abi lity to do so. <br /> <br />The Mayor of the City of San Marcos is further authorized, <br />upon the execution of said indenture by the United States <br />of America, to accept delivery of said instrument from the <br />United States of America. <br /> <br />PASSED AND APPROVED this 14th <br /> <br />d'~b~6" <br /> <br /> <br />Ell is Serur <br />Mayor <br /> <br />I <br /> <br />ATTEST: <br /> <br />" n'j<, <br />,('c.'
