o R DIN A N C E I AN ORDINANCE ESTABLISHING CHARGES FOR THE PICKUP OF GARBAGE WITHIN THE LIMITS OF THE CITY OF SAN MARCOS INSOFAR AS RESI- DENCES ARE CONCERNED; PROVIDING THAT SUCH CHARGES ALLOW NO CREDITS FOR VACANCIES; PROVIDING THAT SUCH CHARGES BE DEBITED TO EACH ACTIVE WATER METER ACCOUNT; PROVIDING THAT TRASH AND BRUSH PICKUP BE AVAILABLE ONCE PER WEEK AS PART OF THE FIXED CHARGE IF TB~ CITY IS CALLED UPON TO MAKE SUCH PICKUP; PROVIDING FOR CHARGES FOR THE PICKUP OF GARBAGE INSOFAR AS COMMERCIAL ESTABLISHMENTS ARE CONCERNED, REPEALING ALL LAWS IN CONFLICT HEREWITH AND PROVIDING A SAVINGS CLAUSE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: That charges for the pick-up of garbage within the limits of the City of San Marcos shall be upon the following basis: Section 1. For the pick-up of garbage at a single-family residence------$1.50 For the pick-up of garbage at a duplex, triplex, or garage apartment (for each unit thereof)--------------------- 1.50 For the pick-up of garbage at an apartment house containing four or more family units where such units are jointly metered: $L 50 for first unit and $1.00 for each additional unit. Section 2. The above charges allow for periodical vacancies; therefore, no credit will be given where a vacancy develops in the future. .Said charges are minimum charges and such will be debited to each water meter account while that account is active. I Section 3. Trash and brush will be picked up once per week without additional charge if the City of San Marcos is notified of the necessity for such pick-up. Section 4. The above charges governing the pick-up of garbage at commercial establishments shall not apply where the owner, manager, or lessee of any such commercial establishment does not provide garbage cans which comply with the requirements concerning such receptacles as set forth in the "Garbage Ordinance" of the City of San Marcos; but, instead in such cases of non-compliance, the charges for picking up such garbage shall be calculated at the rate of $12.00 per hour based upon the weekly average collection time. Section 6. All ordinances, resolutions) or parts of ordinances or resolutions, in conflict herewith, are hereby repealed. Section 7. If any article, subdivision, paragraph, clause, section, phrase, or sentence of this ordinance, or the application thereof to a par- ticular person, set of persons, or to a particular set of circumstances, should, for any reason, be held invalid, such invalidity shall in no wise affect the renaining provisions hereof, and to such end the var- ious provisions hereof are declared to be separable.
