O. 52895, Texas Educational Foundation, Inc., Buyer, <br />and city of San Marcos. Texas, Seller <br /> <br />L Scope. Seller will furnish all Buyer's requirements for water <br /> <br />at point of deliver,y at entrance to Gary Training Center on State High~ <br /> <br /> <br />wa;y 21 in Caldwell County, Texas. Seller shall have 3,000 gallons per <br /> <br />minute of water continuously available at the point of delivery at <br /> <br />pressure of not less than 80 pounds per square inch gauge. <br /> <br />2. Quality of Water. Water supplied by Seller will be clear, <br /> <br />potable water, safe for human consumption, in accordance with standards <br /> <br />adopted by the United States Public Health Service for drinking and <br /> <br />Culinary water supplies for common carriers in interstate commerce, <br /> <br />and such revisions thereof as may be made from time to time. <br /> <br />3. Price. In addition to such other mutual considerations as are <br /> <br />herein provided, Buyer shall pay to Seller the sum ?f $222.55 each month, <br /> <br />plus an amount equal to 15 cents per 1000 gallons of water furnished in <br /> <br />excess of 1,000,000 gallons per month. <br /> <br />4,. Metering. All water furnished by Seller to Buyer, and such <br /> <br />portion thereof as may be re-delivered by Buy~r to Selier, shall be <br /> <br /> <br />measured by suitable meters of standard manufacture to be furnished, <br /> <br />installed, maintained, calibrated and read by Seller at its expense. <br /> <br />In the event any meter fails to register correctly the water furnished <br /> <br />there-through, the parties shall e.gre\l, upon th~ length of period during <br />Which su~h meter failed to register correctly and the. quantity of water <br /> <br />?
