" . <br /> ... <br /> I <br /> <br />I <br /> <br />I <br /> <br />113 b <br /> <br />SCHEDULE <br /> <br />Annexed to P.o. 52895, Texas Educational Foundation, Inc., Buyer, <br />and City of San Marcos, Texas, Seller <br /> <br />delivered there-through during the period and upon agreement an appropriate <br /> <br />adjustment shall be made in the invoices. For the purpose of the prec~d- <br /> <br /> <br />ing sentence, any meter Which registers not more than 2 per cent slow or <br /> <br />fast shall be deemed correct, Seller, at its expense, shall periodically <br /> <br />inspect and test the meters installed by it at intervals not exceeding <br /> <br />one year. Upon request by Buyer, Seller shall make additional tests of <br /> <br />any meter in the presence of Buyer's representatives. The cost of such' <br /> <br />additional tests shall be borne by Buyer if the percentage of error is <br /> <br />found to be not more than 2 per cent slow or fast. No meter shall be <br /> <br />allowed to remain in service which has an error in registration in excess <br /> <br />of .2 per cent under normal operating conditions. <br /> <br />5. Billing. The Seller shall read the meters at intervals of ap- <br /> <br />proximately one month. Billings based on meter readings of.less than <br /> <br />27 days or more than 32 days shall be prorated accordingly. <br /> <br />6. Interruptions. Seller shall use reasonable diligence to provide <br /> <br />a regular and uninterrupted supply of. water at the delivery point, but <br /> <br />shall not be liable for damages to the Buyer for failure, suspension, <br /> <br />diminution or other variations of water service occasioned by or in <br /> <br />consequence of any cause beyond the control of the Seller, including, <br /> <br /> <br />but not'limited to, acts of God or the public enemy, fires, floodS, <br /> <br /> <br />earthquakes or other catastrophes, strikes or failure or breakdown <br /> <br />. 2 - <br />
